This chapter shall be known and may be cited as the Litter Control Regulations of Frankford Township.

For the purpose of this chapter the following terms, phrases, words and their derivations shall have the meaning given herein.
AUTHORIZED PRIVATE RECEPTACLE
Shall mean a container of watertight construction with a tight-fitted lid or cover capable of preventing the escape of contents within. Such receptacles shall have handles or other means for safe and convenient handling and be of such size or sufficient capacity to hold all litter generated between collection periods and shall be in compliance with the regulation promulgated by the Township.
DEPOSIT
Shall include throw, dump, cast, accumulate, discharge or words of similar meaning.
GARBAGE
Shall mean putrescible animal and vegetable waste resulting from the handling, preparation, cooking or consumption of food.
LITTER
Shall mean any used or unconsumed substance or waste materials which have been discarded whether made of aluminum, glass, plastic, rubber, paper, or other natural or synthetic material, or any combination thereof including, but not limited to, any bottle, jar or can, any unlighted cigarette, cigar, match of any flaming or glowing material or any garbage, trash, refuse, debris, rubbish, grass clippings or other lawn or garden waste, newspaper, magazines, glass, metal, plastic or paper containers or other packaging or construction material but does not include the waste of the primary processing of mining or other extraction processes, logging, sawmilling, farming, manufacturing or composting.
PERSON
Shall mean any person, firm, partnership, association, corporation, company or organization of any kind.
PRIVATE PREMISES
Shall mean all property including, but not limited to, vacant land or any land, building or other structure designed or used for residential, commercial, business, industrial, institutional or religious purposes, together with any yard, grounds, walk, driveway, fence, porch, steps, vestibule, mailbox and other structure appurtenant thereto.
PUBLIC PLACE
Shall mean any and all streets, sidewalks, boulevards, alleys or other public ways, lakes, rivers, watercourses or fountains and any and all public parks, squares, spaces, grounds and buildings.
PUBLIC RECEPTACLES
Shall mean any receptacles provided by or authorized by the Township.
RUBBISH
Shall mean nonputrescible solid wastes consisting of both combustible wastes, such as but not limited to paper, wrappings, cigarettes, cardboard, tin cans, yard clippings, leaves, wood, grass, bedding, crockery, building materials and other similar materials.
VEHICLE
Shall mean every device in, upon or by which any person or property is or may be transported or drawn upon land or water, including devices used exclusively upon stationary rails or tracks.

No person shall deposit nor shall any owner of the property allow its guests, invitees, agents or its tenants to deposit any litter within the Township except in public receptacles, or in authorized private receptacles for collection or in any duly licensed disposal facility.

No person shall upset or tamper with a public or private receptacle designed or used for the deposit of litter or cause or permit its contents to be deposited or strewn in or upon any public place or private premises.

a. 
No person shall deposit litter upon any public place or private premises while operator of or passenger in a vehicle.
b. 
No person shall drive or move any truck or other vehicle within the Township unless such vehicle is so constructed or loaded as to prevent any load, contents or litter from being blown or deposited upon any public place or private premises, excluding from this section farm vehicles being used for farming purposes.

a. 
It shall be unlawful for any person to discard or dump along any street or road, on or off any right-of-way, any litter including but not limited to household or commercial solid waste, rubbish, refuse, junk vehicles or vehicle parts, rubber tires, appliances, furniture in any place not specifically designated for the purpose of solid waste storage or disposal.
b. 
It shall be unlawful for any person to discard or dump any litter including but not limited to household or commercial solid waste, rubbish, refuse, junk vehicles or vehicle parts, rubber tires, appliances, furniture into a private receptacle or property, except by verbal or written consent of the owner of said property or receptacle.

It shall be unlawful for any residential property owner to store or permit storage of any bulky household waste, including household appliances, furniture and mattresses, in areas zoned residential, except in a fully enclosed structure or during days designated for the collection of bulky items.

It shall be unlawful for any residential or commercial property owner to permit open or overflowing waste disposal bins on his or her property.

If it appears that the trash, garbage or other prescribed material has been cast on any property by one or more persons not the owner thereof, and if there is evidence of the identity of such person or persons, a complaint for violation of this chapter may be filed against such person or persons in the Municipal Court, by any of the following: the Police, Board of Health, Township or the designated official of any of the above. In the event any litter deposited upon public or private property other than in a litter receptacle contains any correspondence, invoices, address or shipping labels, magazine labels or similar documents identifying any person, it shall be presumed that the person or persons so identified deposited the materials in violation of this chapter.

Notwithstanding any other cost of penalty imposed by this chapter, any person found to be in violation of any provision of this chapter shall be responsible to reimburse the Township for any and all costs incurred in the cleanup of the discarded garbage, litter or rubbish.

The maximum fine shall not exceed $500 for each separate offense. It shall be deemed that a separate offense is committed on each day on which a violation occurs or continues to occur without further notice to the violator.
Action under this chapter shall not preclude the Township from taking any other action under any other rights they may have by statute or ordinance and imposing additional fines under the same.
All fines recovered in any prosecution for a violation of this chapter shall be paid into the treasury of the Township.
