Pursuant to Section 11 of the Uniform Fire Safety Act, (P.L.
1983 c.383), the New Jersey Uniform Fire Code shall be enforced within
the corporate limits of the Borough.

The local enforcing agency shall be the Ocean County Bureau
of Fire Safety.

The Ocean County Bureau of Fire Safety shall enforce the Uniform
Fire Safety Act and the codes and regulations adopted under it in
all buildings, structures and premises within the established boundaries
of the Borough, other than owner occupied one and two-family dwellings,
and shall faithfully comply with the requirements of the Uniform Fire
Safety Act and Uniform Fire Code.

The periodic inspections of life hazard uses required by the
Uniform Fire Code shall be carried out by the Ocean County Bureau
of Fire Safety.

The Ocean County Bureau of Fire Safety shall be under the direct
supervision of the Fire Official who shall be the Ocean County Fire
Marshal.

Pursuant to Sections 15 and 17 of the Uniform Fire Safety Act,
any person aggrieved by any order of the local enforcement agency
shall have the right to appeal to the Construction Board of Appeals
of the County of Ocean.

The permit fee shall be established pursuant to the Uniform
Fire Code. They shall be as follows, unless modified by Borough ordinance
and resolution of the Ocean County Board of Chosen Freeholders:

a. In accordance
with the provisions of the Uniform Fire Code, N.J.A.C. 5:70-1 et.
seq., all owners of residential property within the Borough must apply
for a smoke alarm, carbon monoxide alarm, and portable fire extinguisher
inspection and obtain a Certificate of Compliance prior to any change
in occupancy or the commencement of a lease or rental of the property.
All residential property owners renting the property on a seasonal
basis must apply for a smoke alarm, carbon monoxide alarm, and portable
fire extinguisher inspection of the residence and obtain a Certificate
of Compliance annually.
b. Permit Fees.
Effective January 1, 2019, the application fee for a certificate of
smoke alarm, carbon monoxide alarm, and portable fire extinguisher
compliance (CSACMAPFEC), as required by N.J.A.C. 5:70-2.3, shall be
based upon the amount of time remaining before the change of occupant
is expected, as follows:
1. Requests
for a CSACMAPFEC received more than 10 business days prior to the
change of occupant: $45.
2. Requests
for a CSACMAPFEC received four to 10 business days prior to the change
of occupant: $90.
3. Requests
for a CSACMAPFEC received fewer than four business days prior to the
change of occupant: $161.
4. Certification
in lieu of inspection for a CSACMAPFEC: $45.
