For the purposes of this article, the following terms shall have the following meanings:
BOTTLE ROCKETS OR OTHER SIMILAR FIREWORKS
Any type of explosive device which contains an incendiary propellant and fuse which, upon ignition, launches more than 10 feet into the air any solid material which is not designed to be completely consumed by combustion, deflagration or detonation, so that upon such combustion, deflagration or detonation there remains no solid material to fall to the ground.
FIREWORKS
Explosive devices designed primarily to produce visible or audible effects by combustion, deflagration or detonation, including but not limited to Roman candles, skyrockets, bottle rockets, salutes, firecrackers, torpedoes, mines, fountains, flower pots, bombs, pin wheels, blank cartridges, toy guns other than cap pistols or any other device or article loaded or impregnated with combustible or inflammable material, or any firecrackers or fireworks by whatever name designated; provided, however, that such definition shall not include caps or cap pistols.

It shall be unlawful to sell or transfer possession of any fireworks within the City limits except during the period from June twentieth (20th) to July fifth (5th), inclusive, of any year.

(a) 
It shall be unlawful to:
(1) 
Store, keep or sell any fireworks within 50 feet of any area in which volatile solids, liquids or gases are stored, including but not limited to service stations and grain facilities;
(2) 
Permit the presence of lighted cigars, cigarettes, pipes or any other open flame within 50 feet of the place where fireworks are sold;
(3) 
Sell, or offer for sale, any fireworks that have not been approved and labeled as Class C Fireworks by the Interstate Commerce Commission. The ICC Class C Label must be visible on the fireworks or the smallest container in which they are sold, and said label shall be on the fireworks, or package, or both, that is received by the general public from the dealer.

(a) 
No person, group, business entity, charity or any other organization whatsoever shall engage in the sale of fireworks within the City limits unless and until they have first obtained a permit to sell fireworks. Said permit shall be obtained from the City Clerk, upon the applicant paying a fee of $50.00 starting in 2023 with increases in fee of $50.00 every year until the fee reaches $250.00 in 2027 and beyond, and providing the City Clerk with an affidavit, or other good proof that the anticipated sale of fireworks will be conducted in accordance with Section 11-133.
(b) 
No person shall ignite, discharge, explode or set off any fireworks within the City limits on any days of the year other than the 3rd and 4th of July without written consent and approval of the Mayor and Special Event Committee. Hours for discharging fireworks on the 3rd of July will be limited to 10:00 a.m. to 10:00 p.m. unless it falls on Sunday which discharging would be from Noon to 10:00 p.m.

It shall be unlawful for any person to aid or abet any other person, whether adult or minor, to ignite, discharge, explode or set off any fireworks in violation of Section 11-134. The words "aid" or "abet," as used in this section, are defined to include the purchase of any such fireworks by any parent or other person for his minor child or any other minor child, or allowing one's minor child or any other minor child to so discharge any fireworks on his or another person's property or in his presence.

(a) 
It shall be unlawful to:
(1) 
Explode or ignite fireworks within 100 feet of any church, hospital, asylum, nursing home facility or public school, or within 100 feet of the place where fireworks are stored, sold, or offered for sale, or within 50 feet of any area in which volatile solids, liquids or gases are stored, including but not limited to service stations and grain facilities;
(2) 
Ignite or discharge any article of fireworks within, or throw the same from, a motor vehicle, or to place or throw any ignited article of fireworks into or at a motor vehicle, or at or near any person or group of people.
(3) 
Ignite or discharge any article of fireworks upon any public street within the City.

(a) 
No person shall sell, possess or discharge any ground salutes commonly known as "Cherry Bombs," "M-80's," "M-100's," "M-1000's" and various other tubular salutes which exceed the limits set for Class C common fireworks by the department of transportation for explosive composition.
(b) 
No person shall sell, offer for sale, give away or discharge any bottle rockets or other similar fireworks within the Butler City limits without the express written consent and approval of the Mayor.
