There is hereby established on the property owned by the Borough,
commonly known as the Borough Parking Lot located at the intersection
of Monmouth Road and Cedar Avenue, a parking lot consisting of three
zones, the locations to be fixed by Resolution of Mayor and Council,
and shall be appropriately marked by signs or other identifying notices.
The zones shall be as follows:
c. Four Hour Public Parking.

8-1.1c shall apply to all Borough-owned parking lots, particularly, but not limited to, the Borough parking lot at 965 Broadway.

2. Exempted
from the parking restrictions above are vehicles used for the West
Long Branch Police Department, West Long Branch Fire Department, West
Long Branch EMS, and West Long Branch borough employees.

The areas designated for "Fire and First Aid Only" may be used
only for the purpose of parking motor vehicles by members of the West
Long Branch Fire Department and West Long Branch Emergency Medical
Services, Inc.

The areas designated for "Borough Employees Only" may be used
only by the Borough Employees for the parking of their vehicles.

The areas designated for "Four Hour Public Parking" may be used
by any person of the general public who desires to park a vehicle
for a period not exceeding four hours.

8-1.4, which prohibit parking for more than four hours, shall apply to all Borough parking lots.

a. Any member of the public who shall park or allow to stand, a motor vehicle of any kind, as defined in R.S. 39:1-1 in the areas designated "Fire and First Aid Only" or "Borough Employees Only" shall, upon conviction, be subject to a fine as established in Chapter
1, Section
1-5 of this Code.
b. It shall be permissible for any member of the public to park or allow to stand, a motor vehicle of any kind in the area designated "Four Hour Public Parking" for a period not exceeding four hours in a 24 hour period. Any member of the public who shall park or allow to stand a motor vehicle in the "Four Hour Public Parking" section of the parking lot for a period in excess of four hours in any 24 hour period shall, upon conviction be subject to a fine as established in Chapter
1, Section
1-5 of this Code.

As used in this section:
PUBLIC BUILDING
Shall mean any building, structure, facility or complex used
by the general public or to which the general public is invited, including,
but not limited to, theaters, concert halls, auditoriums, museums,
schools, libraries, recreation facilities, public transportation terminals
and stations, factories, office buildings, businesses, shopping centers,
hotels or motels and public eating places whether privately or publicly
owned, except that this term shall not include private family residences.
PHYSICAL HANDICAP
Shall mean a physical impairment which confines a person
to a wheelchair, causes a person to walk with difficulty or insecurity,
affects the sight or hearing to the extent that a person functioning
in public areas is insecure or exposed to danger, causes faulty coordination
or reduces mobility, flexibility, coordination and perception to the
extent that facilities are needed to provide for the safety of that
person.

The owners of all public buildings which provide parking spaces
adjacent to or used in connection with the public building shall within
180 days of notice thereof provide for parking spaces for handicapped
persons in accordance with the guidelines herein set forth and in
a location and manner as determined by the Chief of Police. Any parking
facility with less than eight existing spaces shall be exempt from
the provisions of this section.

Parking spaces for the physically handicapped shall be constructed
according to the following guidelines.
a. A minimum of 1% of the total number of parking spaces in the parking
facility shall be used for handicapped parking, but these shall be
not less than two parking spaces in each such facility, which shall
be provided in an area of the parking facility most accessible and
approximate to the building which the facility services.
b. The location of the physically handicapped spaces shall be in an
area of the parking facility which is most accessible and approximate
to the building which the facility serves. The determination of the
location shall be made by the Chief of Police, in conjunction and
consultation with the owner.
c. Each space or group of spaces shall be identified with a clearly
visible sign displaying the International Symbol of Access along with
the following words, "These Spaces Reserved for Physically Handicapped
Only. Special Vehicle Identification Required." The lines designating
the area shall be painted in fluorescent yellow paint, and the center
of the spaces shall have painted thereon the capital letter "H."
d. Each space shall be twelve (12') feet wide to allow room for
persons in wheelchairs or on braces or crutches to get in or out of
either side of the automobile on a level paved surface suitable for
wheeling and walking.
e. Where possible, such spaces shall be located so that persons in wheelchairs
or using braces or crutches are not compelled to wheel or walk behind
parked cars.
f. Where applicable, curb ramps shall be provided to permit handicapped
people access from parking area to sidewalk.

No person shall park a vehicle in any parking space designated
and marked as being set aside for the physically handicapped in any
parking facility unless the vehicle shall have affixed thereto an
identification certificate or marker issued either by the New Jersey
Director of the Division of Motor Vehicles and/or a local certificate
issued by the Chief of Police. Parking in a handicap space without
the aforesaid vehicle identification shall create a rebuttable presumption
that use of the space was not for the physically handicapped. No operator
of a vehicle shall stand or park the vehicle in any space on public
or private property appropriately marked for vehicles for the physically
handicapped unless a handicapped person is either the driver or a
passenger in that vehicle.

The Chief of Police shall issue free of charge a Borough special vehicle identification card to any physically disabled person (resident or nonresident) who may not qualify for such identification under N.J.S.A. 39:4-204 but does qualify under Subsection
8-2.1 of this section. A physician's certification shall be necessary to establish the qualifying status of such applicant. Each temporary handicapped placard issued under the provisions of this section or N.J.S.A. 39:4-206 shall set forth the date on which the placard or certificate shall become invalid.

Any person who violates any of the provisions of this section
shall be subject to a fine of $100 for the first offense; and, for
subsequent offenses, a fine of at least $100 and up to 90 days community
service on such terms and in such a form as the Court shall deem appropriate,
or any combination thereof.

State, County or municipal law enforcement officers shall enforce
the parking restrictions on spaces appropriately marked for vehicles
for the physically handicapped on both public and private property.
