The Borough Council hereby signifies its intention and desire to organize with the Boroughs of Courtdale, Edwardsville, Forty Fort, Kingston, Larksville, Luzerne, Pringle and Swoyersville, a Joint Authority under the provisions of the Municipal Authorities Act of 1945, P.L. 382, as amended.[1]

The Mayor, President of the Borough Council and the Secretary are hereby authorized and directed to execute on behalf of the Borough of Plymouth Articles of Incorporation for said Joint Authority in substantially the following form:
ARTICLES OF INCORPORATION
TO THE SECRETARY OF THE COMMONWEALTH, COMMONWEALTH OF PENNSYLVANIA:
In compliance with the requirements of the Act of May 2, 1945, P.L. 382, known as the "Municipality Authorities Act of 1945,"[1] the Boroughs of Courtdale, Edwardsville, Forty Fort, Kingston, Larksville, Luzerne, Plymouth, Pringle and Swoyersville, all in Luzerne County, Pennsylvania, desiring to incorporate a Joint Authority thereunder, do hereby certify:
1.
The name of the Joint Authority is "West Side Landfill Authority, Luzerne County."
2.
Said Joint Authority is formed by the Boroughs of Courtdale, Edwardsville, Forty Fort, Kingston, Larksville, Luzerne, Plymouth, Pringle and Swoyersville under the provisions of the Act of May 2, 1945, P.L. 382, as amended.
3.
No other authority organized under this Act or under the Act approved the 28th day of June 1935, P.L. 163, is in existence in or for the incorporating municipalities, except the Wyoming Valley Sanitary Authority for the boroughs of Edwardsville, Forty Fort, Kingston, Plymouth and Swoyersville and the Municipal Authority of the Borough of Plymouth for Plymouth, Pennsylvania.
4.
The names of the incorporating municipalities are the Boroughs of Courtdale, Edwardsville, Forty Fort, Kingston, Larksville, Luzerne, Plymouth, Pringle and Swoyersville.
5.
The names and addresses of their respective municipal authorities are as follows.[2]

The names, addresses and terms of office of the first members of the Board of said Joint Authority, each being a citizen and a resident of the incorporating municipality appointing such member (the terms to be computed from January 1, 1963), are as follows.[3]
IN WITNESS WHEREOF, the undersigned have executed these Articles on behalf of the Borough of Plymouth, and have caused to be affixed the seal thereof this first day of April 1963.[4]

The proper officers of the Borough of Plymouth are hereby directed to cause or join in the publication of the notice of this article and the proposed filing of the Articles of Incorporation as required by Section 3 of the Municipality Authorities Act of 1945.[1] In the publication of this article, as provided in the Act, it is not necessary to set forth the proposed Articles of Incorporation in full, but to set forth briefly the substance thereof and to refer to the provisions of the Act.

The Mayor, President of Borough Council and Secretary of Plymouth Borough are directed to join with the Mayors, Presidents of Borough Councils and Secretaries of the Boroughs of Courtdale, Edwardsville, Kingston, Forty Fort, Larksville, Luzerne, Pringle and Swoyersville and file said Articles of Incorporation, together with the necessary proof of publication, with the Secretary of the commonwealth and to do all other acts and things necessary or appropriate to effect the incorporation of the West Side Landfill Authority of Luzerne County.
The project to be undertaken by the Authority is the financing, contracting for and/or provision of facilities and labor for the sanitary disposal of garbage, refuse and rubbish, including the management and/or the operation of a sanitary landfill site.
