The Plymouth Borough Council recognizing the special needs of handicapped persons in Plymouth Borough hereby establishes a reserved parking program which will facilitate access to and from the handicapped person's place of residence.

As used in this chapter, the following terms shall have the meanings indicated, unless a different meaning clearly appears from the context:
HANDICAPPED PERSON
An individual possessing a handicapped or severely disabled veteran registration plate.
ISSUING AUTHORITY
Plymouth Borough Traffic Committee.
RESERVED PARKING SIGN
A sign issued by Plymouth Borough reserving parking for one vehicle space and erected at a designated and agreed upon area for access for handicapped persons.
In this chapter, the singular shall include the plural, the plural shall include the singular, and masculine shall include the feminine and neuter.
A. 
The Borough of Plymouth will promulgate and have available applications for reserved parking signs. Said applications can be obtained from the administration office located in the Plymouth Borough Municipal Building, 162 West Shawnee Avenue, Plymouth. Once the application has been completed it should be submitted to the Plymouth Borough Traffic Committee for consideration.
B. 
Application fee. Upon submission of an application, the applicant shall pay a fee of $35 to Plymouth Borough. Said application fee will be nonrefundable to cover the processing of the application.
C. 
All approved applications shall be subjected to annual review and are subject to revocation for cause. At any review, the applicant must submit a current written statement from his/her physician describing the disability and the anticipated duration of the disability.
D. 
Applications must possess a handicapped or severely disabled veteran registration plate in order to obtain an application. (Owners of disabled veteran plates as distinguished from owners or severely handicapped veteran's plates are not eligible for handicapped parking signs).
E. 
Applications are to be completed in their entirety. applications. Applications not completed in their entirety will not be considered.
F. 
Each applicant shall submit with the completed application a written statement from his or her physician describing the disability at the time of application, including, but not limited to, the anticipated duration of the disability.
G. 
Approval or denial of applications will be made within 60 days by the Plymouth Borough Traffic Committee (issuing authority).
H. 
Upon approval of an application and payment of requisite fees the Borough of Plymouth will erect two reserved parking signs with the applicant's vehicle registration number for use by the applicant.
I. 
The Plymouth Borough Traffic Committee shall maintain a log of all allocations for a reserved parking sign and shall periodically provide the Plymouth Borough Police department a copy thereof.
A. 
It shall be unlawful for any person or owner or realty to erect a reserved parking sign or handicapped parking sign upon the streets of Plymouth Borough without first making application to the Plymouth Borough Traffic Committee. Any person who erects or utilizes a reserved parking sign or a handicapped parking sign who has not followed the requirements of this chapter is subject to penalties set forth herein.
B. 
Any stipulations made at the time of application regarding the eligibility of an applicant may be updated periodically at the request of the Plymouth Borough Traffic Committee.
C. 
Reserved parking signs shall not supersede existing parking regulations, including, but not limited to, street sweeping snow ban or snow removal regulations.
D. 
Reserved parking signs will remain the property of Plymouth Borough.
E. 
Plymouth Borough shall be notified immediately if an eligible person no longer qualifies for a sign under this chapter; for example, if an eligible person enjoys an improved health condition or moves from the premises wherein the sign is located. Failure to notify Plymouth Borough constitutes a violation of this chapter.
F. 
Plymouth Borough will take the following factors into consideration when issuing reserved parking signs.
(1) 
Overall availability of parking in the area wherein a sign is requested shall be taken into consideration.
(2) 
The living arrangements of an individual applicant shall be taken into consideration; for example, a disabled person living alone and responsible for his or her own transportation.
(3) 
Existing parking problems in the area where a sign is requested.
G. 
The Plymouth Borough Police Department reserves the right to remove any reserved parking signs or handicapped parking signs for cause shown.
H. 
No reserved parking sign will be placed in front of the home of a person other than the applicant unless that property owner signs a notarized statement stating that they have no objection to the placement of the sign.
I. 
The reserved parking area will be defined by the placement of two reserved parking signs. Each reserved parking sign shall state the license plate number of the vehicle authorized to occupy the reserved parking space.
J. 
Handicapped parking spaces permitted under this chapter are exclusive and are to be considered a reserved parking space.

A. 
Any person who parks in a reserved parking space, who is not authorized to do so shall be subject to immediate citation and the vehicle will be subject to immediate removal at the owners expense, including payment of towing fees and any storage or impounding fees.
B. 
No person shall erect a reserved or handicapped parking sign upon the street of Plymouth Borough without authority under this chapter from the Plymouth Borough Traffic Committee.
C. 
Any person violating any provisions of this article shall, upon summary conviction thereof in a summary proceeding before a Magisterial District Judge be subject to pay a fine of not less than $50 and not more than $200 and costs of prosecution. In addition to any fine above an additional $50 fine shall be imposed as provided for pursuant to 75 Pa.C.S.A. § 3354(G) of the Pennsylvania Motor Vehicle Code, as amended.
The provisions of this chapter are severable. If any part of this chapter is declared to be unconstitutional, illegal or invalid, the validity of the remaining provisions shall be unaffected thereby. It is the intention of the Plymouth Borough Council that this chapter would have been adopted had such unconstitutional, illegal or invalid part not been included.
