N.J.S.A. 40:55D-8 and 40:55D-53, provisions of the Municipal
Land Use Act, authorize the municipality to charge reasonable fees
for the review of all applications for development as well as fees
for any required inspection services by the Borough Engineer.

Every application for development to the West Cape May Planning
Board shall be accompanied by a nonrefundable application fee and
an initial escrow deposit, in the following amounts, and payable in
cash or certified check made out to the Borough of West Cape May.
No application for development shall be processed unless these fees
are paid in their entirety.

The escrow fees are established to cover the Planning Board's
costs of professional services in connection with the particular application.
The professional staff includes, but is not limited to the following:
Board Attorney, Board Engineer, and other professionals as may be
required on particular applications. Any sums not so utilized shall
be returned to the applicant. In the event the costs for such professional
services by the Planning Board are anticipated to exceed the initial
escrow fee for a particular application, the applicant shall, upon
notice and demand, pay such additional sums to the Planning Board
Secretary. All final approvals are conditioned upon payment of all
required escrow fees; and the Board may cease consideration of any
application where additional escrow deposits have been requested and
not paid by the applicant.

In the event a particular application is not specifically covered by the fee schedule established in Section
26-2, the application fee shall be $100 and the escrow fee shall be $100.

In the event an application concerns several different requests
for a variance pursuant to N.J.S.A. 40:55D-70(c), the applicant shall
be required to pay the appropriate application fee and escrow fee
for each individual variance requested for all such variance requests.

The Administrative Map Fee will only be charged to those applications,
such as subdivision applications, that require a modification of the
Borough's Tax Map as a result of the application.

All fees set forth herein are intended to cover the Borough's
actual costs in administering applications for development.
