The Township Committee shall contract with the Medford Farms
Volunteer Fire Company or the Tabernacle Fire Company No. 1 or such
other volunteer firefighting organization as hereafter may be formed
and operating in the Township of Tabernacle as determined by the Township
Committee for the provision of public firefighting duty and shall
thereby recognize such organization or organizations as the official
volunteer firefighting organization or organizations under the control
of the Township. The Township Administrator shall administer the contract
and manage the provision of service pursuant to said contract.

The Chief or Chiefs shall come from the volunteer staff and
be selected by the Company members in accordance with the by-laws
of the respective volunteer fire company. In addition to managing
the delivery of public firefighting duty the Chief shall:
1.
Advise the Township Committee and make recommendations regarding
public safety issues and the Township's ability to handle public
safety concerns and emergencies.
2.
Advise the Township Committee on educating the community about public
safety issues, concerns, and programs.
3.
Review public safety policies and plans.
4.
Facilitate community involvement in public safety and increase citizen
awareness.
5.
Improve and promote cooperation and coordination between the community
and its public safety agencies.

The objective of any fire company delivering firefighting services
in the Township is the protection and preservation of life and property.
The age of active members hereafter joining any fire company operating
in the Township shall be above the age of 18 except for junior members
who shall not be deemed fully active members but shall serve at the
discretion and direction of the chief of the fire company. The Township
Administrator shall have the right to require the completion and submission
of any and all applications, certifications or other qualifying information
deemed necessary pursuant to the Township's various policies
of insurance in effect from time to time from any current or prospective
member at any time as to their physical fitness and ability to fulfill
firefighting service responsibilities. Further, all members must comply
with any and all Federal, State or other rules and regulations pertaining
to firefighting service qualifications for membership and any rules
and regulations established by the Township Committee from time to
time.

Members, volunteers and employees may not consume any tobacco
products or alcohol while on duty or at any time when in Township
vehicles, public buildings or during training. "Tobacco product" means
smoking and smokeless tobacco.

The Uniform Fire Safety Act, (P.L. 1983, c.383) was enacted
for the purpose of establishing a system for the enforcement of minimum
fire safety standards throughout the State of New Jersey, and the
Uniform Fire Safety Act authorizes municipalities to provide for local
enforcement and to establish local enforcement agencies for that purpose.
It is in the best interest of the Township of Tabernacle to have the
Uniform Fire Safety Act enforced locally.

Pursuant to Section 11 of the Uniform Fire Safety Act, N.J.S.A.
52:27D-202, the New Jersey Uniform Fire Code shall be enforced locally
within the Township of Tabernacle.

The Local Enforcing Agency within the Township of Tabernacle,
County of Burlington, State of New Jersey shall be the Tabernacle
Township Office of Code Enforcement and, specifically, the Fire Subcode
Official/Fire Marshal.

The Local Enforcement Agency shall enforce the Uniform Fire
Safety Act and the codes and regulations adopted under it in all buildings,
structures and premises within the established boundaries of the Township
of Tabernacle other than owner-occupied one and two family dwellings,
and shall faithfully comply with the requirements of the Uniform Fire
Safety Act and the Uniform Fire Code.

The Local Enforcing Agency established by subsection 11-2.3 shall carry out the periodic inspections of life hazard uses required by the Uniform Fire Code on behalf of the Commissioner of Community Affairs.

Pursuant to N.J.S.A. 52:27D-206(b) of the Uniform Fire Safety
Act, any person aggrieved by any order of the local enforcement agency
shall have the right to appeal to the Construction Board of Appeals
of Burlington County.

The inspection fees and costs required pursuant to the Uniform
Fire Safety Act and the regulations of the State of New Jersey Department
of Community Affairs, shall be charged consistent with APPENDIX A
"FEE SCHEDULE" as attached to the Revised General Ordinances of Tabernacle
Township and specifically "Schedule J" as modified from time to time.

a.
The owner or person in control of the following types of buildings
shall install and maintain a Fire Department Repository Unit of a
type approved by the Chief:
1.
Any apartment building or other rental building containing four or
more residential living units and in which access to the building
or to common areas or mechanical or electrical rooms within the building
is denied through locked doors.
2.
Any nonresidential building where a fire detection or suppression
system is monitored by an alarm company or has an external audible
alarm.
3.
Any building or facility containing a quantity of hazardous materials
which would require compliance with Title III of SARA (Superfund Amendment
Reauthorization Act).
b.
Persons or entities who own existing buildings or structures which
are subject to the requirements of this section shall have one year
from the effective date of this section to comply with the requirements.
Persons or entities who construct buildings or structures which would
be subject to the requirements of this section shall comply with these
requirements at the time of construction.

a.
The owner or person in control of buildings or facilities described in subsection 11-3.1a shall cause to be placed in such repository unit a key to the following areas:
1.
Locked points of access in the exterior of the building or facility;
2.
Locked points of access to common areas, such as hallways or utility
rooms, contained within such buildings or facilities;
3.
Locked mechanical rooms;
4.
Locked electrical rooms;
5.
All other locked areas, other than individual apartments or rented
rooms, as directed by the Chief.

The owner or person in control of any building or facility described in subsection 11-3.1 required to have a Fire Department Repository Unit shall be present, himself or through his agent, during access to such repository unit by the Fire Department except when the Fire Department has responded to an emergency at the property.

The Chief may establish rules and regulations for the placement
and maintenance of Fire Department Repository Units on applicable
buildings within the Township of Tabernacle, including approved types
of Fire Department Repository Units. Proposed units and regulations
shall be submitted to the Township Committee and filed with the Township
Clerk and shall become effective 14 days after submission to the Township
of Tabernacle Committee.

The owner or person in control of any building or facility described in subsection 11-3.1 required to have a Fire Department Repository Unit shall do the following:
a.
Provide keys capable of access to such Fire Department Repository
Unit at all times to the Fire Department.
b.
Maintain current information of hazardous materials stored in the
building or facility in the Fire Department Repository Unit or, if
the volume of material is too large to place in the repository unit,
shall file said information with the Chief.

The Township of Tabernacle assumes no liability for any of the
following:
a.
Any defects in the operation of the repository unit, or any of the
keys contained within such repository unit or the use thereof or any
information stored within the repository unit or otherwise provided
to the Township of Tabernacle;
b.
The failure or neglect to respond appropriately upon receipt of an
alarm from an alarm system;
c.
The failure or neglect of any owner or person in control of a building
or facility required to have a repository unit to provide access to
the repository unit; or
d.
The security of any property required to have a repository unit due
to access to the repository unit by any person.
