It is the intent and purpose of this Article to restrict the placement of certain trailers and certain containers within the improved portion of public roadways within the Borough of Woodbury Heights.
For the purposes of this Article, the following terms, phrases, words and their derivations shall have the meanings stated herein unless their use in the text of this Article clearly demonstrates a different meaning. When not inconsistent with the context, words used in the present tense include the future tense, words used in the plural number include the singular number and words used in the singular number include the plural number.
CONTAINER
Any vessel, structure, can or other device used or capable of use for the placement of trash, refuse, vegetative waste, equipment or materials except trash or recycling containers used or intended for use for municipal collection of trash or recyclable materials by the Borough of Woodbury Heights.
TRAILER
Any device including licensed trailers designed or adapted for use for travel over public roadways and intended for the transport, storage or use of equipment, refuse or goods and materials and, without limitation, not capable of movement without the assistance of a separate motorized vehicle.
ROADWAY
Any street, avenue, boulevard, road, drive or other right-of-way which is an existing state, county or municipal roadway including the land between the street right-of-way lines that is improved with a surface comprised of concrete or bituminous mix pavement.
PERSON
Any individual, corporation, company, partnership, firm, association or political subdivision of this state subject to municipal jurisdiction.
No person shall permit, allow, place or suffer the placement or storage of any trailer in any roadway of the Borough of Woodbury Heights between the hour and time of sunset and the hour and time of sunrise except such trailers that are attached to duly registered and operable motor vehicles and except such trailers that are actively being utilized to load or unload its contents or load. Further, no person shall place, store, locate or permit the placement, storage or location of containers within roadways of the borough between the hours of sunset and sunrise except in period and times of public emergency whether or not such containers are being actively used to load or unload trash, refuse, goods or materials.
This Article shall be enforced by the Woodbury Heights Police Department.
Any person in violation of the provisions of this Article shall be subject to a fine not to exceed $500 per any one incident or occurrence.
