[HISTORY: Adopted by the Village Board of the Village of Reeseville 8-14-2014 by Ord. No. A-89 (Sec. 5-2-9 of the 1992 Code). Amendments noted where applicable.]
No person, firm or corporation shall build any outdoor fire within the corporate limits of the Village of Reeseville excepting as set forth in § 215-2 of this chapter. This prohibition on burning includes burning of construction waste and debris at construction sites.

The prohibition stated in § 215-1 shall not apply to the following:
A. 
Outdoor cooking over a fire contained in a device or structure designed for such use is permissible.
B. 
Firepits for recreational use are allowed under the following conditions.
(1) 
The firepit must be made of steel, stone or other masonry material.
(2) 
A stone, concrete, or other masonry surface must extend one foot beyond the firepit.
(3) 
The pit must have a metal-screened spark guard completely covering it.
(4) 
The firepit must be a minimum of 15 feet away from any buildings, wooden decks, structures, vehicles, or any flammable items.
(5) 
The firepit must not be located under any trees, overhangs, or covered porches.
(6) 
Gasoline or other volatile fluids may not be used to start or restart any fire in the firepit.
(7) 
Only the burning of dry, nontreated wood is permitted.
(8) 
The firepit cannot be used during windy conditions.
(9) 
Any fire in any firepit must be attended at all times by at least one responsible person of age 18 or older. The fire must be completely extinguished before the firepit is left unsupervised.
(10) 
In the event that smoke from any firepit creates a nuisance for neighboring property owners, the owner may file a complaint with the Police or Fire Department. If it is determined to be a nuisance, the Police or Fire Department may order it extinguished.[1]

C. 
Ceremonial campfire or bonfires, with prior written approval of the Fire Chief, may be permitted.
The Fire Chief is permitted to prohibit any or all bonfires, firepit fires, and any outdoor fires when atmospheric conditions or local circumstances make such fires hazardous. The Fire Chief may also order any exception in § 215-2 above to be extinguished which is dangerous, excessive, or a threat to buildings or public safety.
No materials may be burned upon any street, curb, gutter or sidewalk.
The property owner and/or person who have started any fire shall hold the Village harmless from any and all such liability for any damage caused by such fire.
The Reeseville Fire Department is exempt from the provisions of this chapter for fires for training, controlled burns, and similar fires under the supervision of the Fire Department.
