N.J.S.A. 40:48-2 provides in relevant part that a municipality
may make and enforce such ordinances, rules and regulations not contrary
to the laws of this state or of the United States as it may deem necessary
and proper for the good government, order and protection of persons
and property, and for the preservation of the public health, safety
and welfare of the municipality and its inhabitants.
The purpose of this article is to establish the standards and
to regulate the manner by which existing structures and premises within
the City shall be maintained to preserve the environmental quality
of the City and to protect the health, safety, and welfare of the
public.
Chapters
2 through
8, inclusive, of the International Property Maintenance Code of 2012 as it may be updated, amended or revised from time to time, are hereby adopted and incorporated herein as if the same were set forth with particularity. These regulations shall be known as the "Property Maintenance Code of the City of Millville."
This article shall be construed liberally and justly to ensure
public health, safety and welfare insofar as they are affected by
the continued use and maintenance of structures and premises.
Any repairs, or alterations to a structure, or changes of use
therein, which may result directly or indirectly from the enforcement
of this article shall be done in accordance with the procedures and
provisions of the State Uniform Construction Code.
All repairs, maintenance work, alterations or installations
which are required for compliance with this article shall be executed
and installed in a workmanlike manner so as to secure the results
intended by this article.
When there are practical difficulties involved in carrying out
structural or mechanical provisions of this article, the public officer
and the construction official shall be permitted jointly to vary or
modify such provision upon application of the owner or the owner's
representative, provided that the spirit and intent of this article
is observed and public health, welfare and safety protected.
Every occupant of a structure or premises shall give the owner
or operator thereof, or the owner's agent or employee, access to any
part of such structure or its premises at reasonable times for the
purpose of making such inspection, maintenance, repairs, or alterations
as are necessary for the owner to comply with the provisions of this
article.
Whenever the public officer finds that an emergency exists in
any structure or part thereof which requires immediate action to protect
the public health and safety, or that of the occupants of said structure
or part thereof, the public officer shall, with proper notice, issue
an order reciting the existence of such an emergency and requiring
that repairs be made to the structure or premises forthwith.
