[1984 Code § 138-1]
As used in this chapter:
Shall mean a person whose permanent residence is within the
corporate limits of the Borough and who actually resides in his residence
for the greater portion of each year, except for temporary absence
on account of business, education, vacation and other similar circumstances.
Shall mean a person designated by the Department of Parks
and Recreation to be in charge of any park area and its activities
and to whom all park attendants of such area are responsible.
Shall mean a park, reservation, playground, pool, recreation
center or any other area in the Borough owned or used by the Borough
and devoted to active or passive recreation.
Shall mean any person who is listed as a property owner in
the tax books of the Borough, any person who is listed in the records
of the Electric and Water Departments as a legal renter of premises
located in the Borough or whose name appears on the records of the
Municipal Clerk as a legal registered voter in the Borough. The husband,
wife, child, children, grandchildren or parents whose permanent, full-time
residence is in the home of a Borough resident is also to be considered
a Borough resident.
Shall mean any wheeled, conveyance, whether motor powered
or self-propelled. The term shall include any trailer in tow of any
size, kind or description. Exception is made for baby carriages and
vehicles in the service of the Borough parks.

a.
No person in a park shall appear at any place in other than proper
clothing. With the exception of the restricted bathing area, "properly
clothed" shall be construed to mean clothing that conforms to commonly
accepted standards.
b.
Solicit alms or contributions for any purpose, whether public or
private.
c.
Build or attempt to build a fire, except in such areas and under
such regulations as may be designated by the Director of Parks and
Recreation. No person shall drop, throw or otherwise scatter lighted
matches, burning cigarettes or cigars, tobacco paper or other inflammable
material within any park area or on any highway, road or street abutting
or contiguous thereto.
d.
Gamble or participate in or abet any game of chance.
e.
Go onto the ice on any of the waters, except such areas as are designated
as skating fields, and provided that a safety signal is displayed.
f.
Sleep or protractedly lounge on the seats or benches or other areas
outside the fenced-in pool areas; or engage in loud, boisterous, threatening,
abusive, insulting or indecent language; or engage in any disorderly
conduct or behavior tending to a breach of the public peace.
g.
Disturb or interfere unreasonably with any person or party occupying
any area or participating in any activity.
h.
Dogs and cats are not permitted in any public park or on the property
of the Senior Citizens Center.

No person in a park shall:
a.
Willfully mark, deface, disfigure, injure, tamper with or displace
or remove any buildings, bridges, tables, benches, fireplaces, railings,
paving or paving material, waterlines or other public utilities or
parts or appurtenances thereof, signs, notices or placards, whether
temporary or permanent, monuments, stakes, posts or other boundary
markers or other structures or equipment, facilities or park property
or appurtenances whatsoever, either real or personal.
b.
Fail to cooperate in maintaining rest rooms and washrooms in a neat
and sanitary condition. No person over the age of three years shall
use the rest rooms and washrooms designated for the opposite sex.
c.
Dig or remove any soil, rock, stones, trees, shrubs or plants, down
timber or other wood or materials or make any excavation by tool,
equipment or any other means.
d.
Damage, cut, carve, transplant or remove any tree or plant or injure
the bark or pick the flowers or seeds of any tree or plant. Nor shall
any person attach any rope, wire or other contrivance to any tree
or plant. A person shall not dig in or otherwise disturb grass area
or in any other way injure or impair the natural beauty or usefulness
of any area.
e.
Climb any tree or walk, stand or sit upon monuments, vases, fountains,
railing, fences or upon any other property not designated or customarily
used for such purposes.

No person in a park shall:
a.
Throw, discharge or otherwise place or cause to be placed in the
waters of any fountain, pond, lake, stream, pool or other body of
water in or adjacent to any park or any tributary, stream, storm sewer
or drain flowing into such waters, any substance, matter or thing,
liquid or solid, which will or may result in the pollution of the
waters.
b.
Dump, deposit or leave any bottles, broken glass, ashes, paper, boxes,
cans, dirt, rubbish, waste, garbage or refuse or other trash. No such
refuse or trash shall be placed in any waters in or contiguous to
any park, or left anywhere on the grounds thereof, but shall be placed
in the proper receptacles where these are provided; where receptacles
are not provided, all such rubbish or waste shall be carried away
from the park by the person responsible for its presence and properly
disposed of elsewhere.

No person in a park shall have brought alcoholic beverages,
nor shall any person drink alcoholic beverages at any time in the
park, except where same may be permitted on special occasions with
the approval of the Borough Clerk and the Director of Police and/or
Chief of Police. A fee of $7.50 shall be paid for each permit. No
person shall enter or use park facilities while under the influence
of intoxicating liquor. Appeals of the decisions of the Borough Clerk
and the Director of Police and/or Chief of Police may be made to the
Borough Council. All such appeals shall be made, in writing, within
10 days of the date of decision of the Borough Clerk and the Director
of Police and/or Chief of Police.

No person in a park shall have brought or have in his possession
or set off or otherwise cause to explode or discharge or burn any
firecrackers, torpedo, rocket or other fireworks or explosives of
inflammable material, or discharge them or throw them into any such
area from land or highway adjacent thereto, except where the same
may be permitted on special occasions by action of the Borough Council.
This prohibition includes any substance, compound, mixture or article
that, in conjunction with any other substance or compound, would be
dangerous from any of the foregoing standpoints.

No person in a park shall swim, bath or wade in any waters or
waterways in or adjacent to any park, except in such waters and at
such places as are provided therefor and in compliance with such regulations
as are herein set forth or may be hereafter adopted. Nor shall any
person frequent any waters or places customarily designated for the
purpose of swimming or bathing or congregate thereat when such activity
is prohibited by the Department of Parks and Recreation or the Director
of Parks and Recreation upon a finding that such use of the water
would be dangerous or otherwise inadvisable.

No person in a park shall:
a.
Picnic or lunch in places other than those designated for that purpose.
The Borough shall have the authority to regulate the activities in
such areas when necessary to prevent congestion and to secure the
maximum use for the comfort and convenience of all. Visitors shall
comply with any directions given to achieve this end.
b.
Violate the regulations that use of the individual fireplaces, together
with tables and benches, follows generally the rule of first come,
first served.
c.
Use any portion of the picnic areas or of any of the buildings or
structures therein for the purpose of holding picnics to the exclusion
of other persons, nor shall any person use such area and facilities
for an unreasonable time if the facilities are crowded.
d.
Leave a picnic area before the fire is completely extinguished and
before all trash in the nature of boxes, papers, cans, bottles, garbage
and other refuse is placed in the disposal receptacles where provided.
If no such trash receptacles are available, then refuse and trash
shall be carried away from the park area by the picnicker to be properly
disposed of elsewhere.

No person in a park shall take part in or abet the playing of
games involving thrown or otherwise propelled objects, such as balls,
stones, arrows, javelins or model airplanes, except in areas set apart
for such forms of recreation. The playing of rough or comparatively
dangerous games, such as football, baseball and quoits, is prohibited
except on the fields and courts or areas provided therefor.

No person in a park shall expose or offer for sale any article
or thing, nor shall be station or place any stand, cart or vehicle
for the transportation, sale or display of any such article or thing.
Exception is here made as to any regularly licensed concessionaire
acting by and under the authority and regulation of the Borough Council.

No person in a park shall:
a.
Fail to comply with all applicable provisions of the State motor
vehicles traffic laws in regard to equipment and operation of vehicles,
together with such regulations as are contained in this chapter and
other ordinances of the Borough.
b.
Fail to obey all traffic officers and park employees, such persons
being hereby authorized and instructed to direct traffic whenever
and wherever needed in the parks and on the highways, streets or roads
immediately adjacent thereto in accordance with the provisions of
these regulations and such supplementary regulations as may be issued
from the Department of Parks and Recreation or the Mayor and Borough
Council.
c.
Fail to observe carefully all traffic signs indicating speed, direction,
caution, stopping or parking and all others posted for proper control
and to safeguard life and property.
d.
Ride or drive a vehicle at a rate of speed exceeding five miles per
hour.
e.
Drive any vehicle on any area except the paved park roads or parking
areas, or such other areas as may on occasion be specifically designated
as temporary parking areas by Department of Parks and Recreation or
the Director.
f.
Park a vehicle in other than an established or designated parking
area, and such use shall be in accordance with the posted directions
there and with the instructions of any attendant who may be present.
g.
Leave a vehicle standing or parked overnight.
h.
Double-park any vehicle on any road or parkway unless directed by
a park official.
i.
Fail to use a muffler adequate to deaden the sound of the engine
in a motor vehicle.

No person in a park shall:
a.
Ride a bicycle on other than a paved vehicular road or path designated
for that purpose. A bicyclist shall be permitted to wheel or push
a bicycle by hand over any grassy area or wooded trail or on any paved
area reserved for pedestrian use.
b.
Ride a bicycle other than on the right-hand side of the road paving
as close as conditions permit, and bicycles shall be kept in single
file when two or more are operating as a group. Bicyclists shall at
all times operate their machines with reasonable care and regard to
the safety of others.
c.
Ride any other person on a bicycle.
d.
Leave a bicycle in a place other than a bicycle rack when such is
provided and there is a space available.
e.
Leave a bicycle lying on the ground or paving or set against trees
or in any place or position where other persons may trip over or be
injured by it.
f.
Ride a bicycle on any road between 30 minutes after sunset and 30
minutes before sunrise without an attached headlight, plainly visible
at least 100 feet in front of, and without a red tailight or red reflector,
plainly visible from at least 100 feet from the rear of, such bicycle.

No person in a park shall bring into or operate any boat, raft
or other watercraft upon any waters, except on approval of the Department
of Parks and Recreation.

Except for unusual and unforeseen emergencies, parks shall be
open to the public every day of the year during designated hours.
The opening and closing hours for each individual park shall be posted
therein for public information.

A bulletin board will be maintained for the benefit of the public
and will announce such events as contests, shows, swim lessons, youth
and adult trips and other up and coming recreational programs.

The finding of lost articles by park attendants shall be reported
to the Director of Parks and Recreation, who shall make every reasonable
effort to locate the owners. The Director shall make every reasonable
effort to find articles reported as lost.

a.
The Director of Parks and Recreation and park attendants shall, in
connection with their duties imposed by law, diligently enforce the
provisions of this chapter.
b.
The Director and any park attendant shall have the authority to eject
from the park any person acting in violation of this chapter.
c.
The Director and any park attendant shall have the authority to seize
and confiscate any property, thing or device in the park or used in
the park in violation of this chapter.

a.
The tennis courts are for the use of Milltown residents and their
guests only.
b.
Tennis courts will be open to all residents and their guests Monday
through Friday until 6:00 p.m. and all day Saturday and Sunday. After
6:00 p.m. weekdays, only adults 16 years of age or older or teenagers
playing with their parents will be allowed.
c.
Use by any group will be limited to one hour.
d.
No more than four persons will be allowed on one court at a time.

Violators of the aforementioned rules as well as of posted rules
and rules of good conduct are subject to ejection from the tennis
area. Flagrant or continuous violation may result in permanent forfeiture
of tennis privileges.

a.
Membership in the Milltown Borough Pool is available to Milltown
residents and nonresidents.
b.
To be admitted to the fenced-in pool area, all persons over the age
of three must have a pool photo identification badge on their possession,
whether or not intending to swim.
c.
Membership photo identification badges can be purchased according
to the badge sale schedule.
d.
Membership does not include optional activities such as swimming
lessons, water aerobics, volleyball, pre-teen nights, day care, day
camps, dances, band concerts, et al., which are available at additional
cost.
e.
Membership fees shall be set by ordinance of the Borough Council.
f.
Loaning of photo I.D. badges to other individuals shall not be permitted
and violation thereof will result in confiscation and forfeiture.

a.
Daily guest swim passes may be purchased by a Borough resident who
must provide proof of residency. Fees for daily guest swim badges
shall be set by ordinance of the Borough Council.
b.
Day camps and day cares may utilize the Milltown Borough Pool either
before or after regular swimming hours, at the discretion of the Director
of Recreation, upon the execution of a Pool-Use Agreement and the
provision of an acceptable Certificate of Insurance naming the Borough
of Milltown as an additional insured.
c.
Any member or Milltown resident may request permission to rent the
Milltown Borough Pool for a pool party on a non-exclusive basis upon
the completion and acceptance of a Pool Party Rental Reservation Form
and payment of the required Pool Party Rental Fees.
d.
Guests must obey all rules of the Borough pool.
e.
Milltown residents are responsible for the conduct of their guests.

Late Fees. A late fee of $15 shall be charged for any payment
not received on or before the due date established for said payment
by the Director of Recreation. The Director of Recreation is hereby
authorized to waive the imposition of any late fee due pursuant to
this subsection for good cause shown.

No person in the pool area shall allow himself or herself to
be so covered with a bathing suit as to indecently expose his or her
person. Bathers shall wear bathing suits only. No cut-offs or shorts
are allowed in the pool.

a.
Regular swimming hours are between the hours of 12:00 noon and 8:00
p.m.
b.
The Director of Recreation shall have the discretion to permit the
pool to operate between the hours of (i) 9:00 a.m. and 12:00 noon;
and/or (ii) 8:00 p.m. and 10:00 p.m. to accommodate day camps, day
cares, parties and/or other special events.
c.
Poor or inclement weather, as well as poor attendance, may lead to
an earlier closing time on any given day, at the discretion of the
Director of Recreation and Pool Manager.
d.
Extremely warm weather may lead to an extended swimming time on any
given day, at the discretion of the Director of Recreation or designee.

a.
Alcoholic beverages are prohibited at the pool during regular operating
hours or any extension thereof by the Director of Recreation or Pool
Manager. No person shall be under the influence of any alcohol at
the pool during regular operating hours or any extension thereof by
the Director of Recreation or Pool Manager.
b.
Alcoholic beverages are permitted to be consumed at the pool during
adult parties sponsored by the Borough Recreation Department, subject
to the following restrictions:
1.
Any adult party at which alcoholic beverages are permitted to be
consumed at the pool must occur at a time other than the normal operating
hours of the pool.
2.
No persons under the age of 21 years may be present at the pool at
any time when alcoholic beverages are permitted to be consumed.
3.
Participants at adult parties are required to bring their own alcoholic
beverages for consumption during adult parties. No alcoholic beverages
shall be offered for sale by the Borough Recreation Department to
participants during any adult party; nor shall any alcoholic beverage
be distributed to participants by the Borough Recreation Department
free of charge during any adult party.
4.
No alcoholic beverages may be consumed in the swimming areas.
5.
Glass containers are prohibited at any adult party.
c.
Food and beverages are only permitted in areas designated by the
Director of Recreation or Designee.
d.
Smoking is not permitted anywhere on pool property at any time.

Lifeguards may, at any time, require any swimmer to take a swim
test when doubtful of his or her swimming ability.

Children nine years of age and under shall be accompanied in
swimming areas by a responsible person over the age of 14 years.

General rules and regulations for the everyday use of the Borough
pool shall be established by the Director of Recreation with advice
from the Recreation Advisory Committee and Pool Manager who may participate
in establishing these rules and approved by the Borough Council. Pool
patrons must also comply with the Bather Rules for Swimming Pools,
Wading Pools, Hot Tubs and Spas promulgated by the New Jersey Department
of Health and Senior Services, set forth at N.J.A.C. 8:26-5.4.

Violators of this section and of posted rules and rules of good
conduct are subject to ejection from the pool area. Flagrant or continuous
violation may result in permanent forfeiture of recreational privileges.
Lifeguards, as well as the Pool Manager and Director of Recreation,
may order violators out of the pool area and may suspend swimming
privileges for a period of time subject to the Pool Manager's and/or
Director's discretion.

An arts and crafts program shall be conducted as part of the
regular summer activities.

Non-Annual Programs. Any programs or events not run on an annual

on minimum participation rate) plus administration fee (10% of cost;

General rules and regulations for the use of Albert Avenue Park
or Borough Park Pavilion shall be established by the Director of Recreation
with advice from the Recreation Advisory Committee and approved by
the Borough Council.
