DIVISION 2. Plumbing Code

The installation of, repair of and extension of all plumbing within the City shall be in accordance with the minimum standards as set forth in the State Plumbing Code of the State Board of Plumbing, a certified copy of which shall be placed on file in the office of the City Auditor. The State Plumbing Code is hereby made a part of this article. (Code 1988)

The City Building Official shall be charged with the enforcement of this article and the plumbing code, unless other provisions are made.

Before any person or licensed plumber shall alter, remodel, repair, improve or install any system of plumbing in any structure in the City of Williston, he shall first make application to the building official for a permit to do such work.
Before any licensed sewer and water installer or licensed plumber shall excavate, lay, relay, tap or repair any water line or sewer pipe, or make any connection with any water or sewer pipe within any alley, street or public grounds within the City of Williston, he shall first make application to the City Engineer for a permit to do such work.

Upon approval of an application for a permit under this division and payment of an appropriate fee or suitable arrangements for payment have been made, a permit shall be issued. No permit nor any amendment thereof as required by the building code shall be issued to any contractor who has an amount overdue for prior permits. The procedures for billing permits shall be adopted by the City Building Official and require that any contractor who does not pay for a permit at the time it is picked up will have 30 days to pay the invoice for all permits issued to such contractor. The fee for any permit shall be established by resolution by the Board of City Commissioners. The building official shall have the right to refuse to charge to any contractor who has failed in the past to make full payment of a properly billed permit fee within 30 days of such billing being sent.

No drainage or plumbing system or part thereof shall be covered until it has been inspected, tested if required, and approved as prescribed in this division.

It shall be the duty of the plumber in charge of work to be inspected to notify the proper administrative authority and the owner, or his authorized agent, orally, by telephone, or in writing, not less than four working hours before the work is to be inspected or tested.

Fees, as established by resolution by the Board of City Commissioners, shall be paid for inspections required by the State Plumbing Code.
DIVISION 3. License

No person shall install or connect any system of piping or apparatus or equipment, designated in this division as "plumbing," or engage in or conduct the business of plumbing, or do any work on the City sewers and water mains in the City, without holding a master plumber's license for the pursuit of such work, issued by the Board of City Commissioners, excepting persons in the employ of the City or operating under a special contract with the City for such work.

Any person employed by a licensed master plumber to engage in the work of plumbing, as defined in this division, shall be licensed as a journeyman plumber by the City.

Nothing in this article shall prevent a person from serving as an apprentice under a licensed plumber, and no master plumber shall allow an apprentice to work at an installation unless such apprentice is working with a licensed plumber on the job.

(1) 
An application for a master or journeyman plumber's license shall be presented to the Board of City Commissioners with the endorsement of the City Building Official, and no person shall receive such license who shall not have first furnished the City Building Official with satisfactory evidence of his ability to ply the trade in accordance with the State Plumbing Code.
(2) 
An applicants for a master or journeyman plumber's license must present a valid license from the State Plumbing Board as evidence that he is qualified to engage in plumbing.

An application for a sewer and water installer's license shall be presented to the Board of City Commissioners with the endorsement of the City Engineer, and no person shall receive such license who shall not have first furnished the City Engineer satisfactory evidence of his ability to ply the trade in accordance with the requirements of the State Plumbing Code. An applicant for a sewer and water installer's license must present a valid license from the State Plumbing Board as evidence that he is qualified to work on the City sewers and water mains.

No master plumber's license or sewer and water installer's license shall be issued under this division until and unless the applicant for such license deposits with the City Building Official a policy or copy thereof of liability insurance. Said policy of liability insurance shall be acceptable to and shall meet the approval of the Board of City Commissioners and shall be issued by a company licensed to do business within the state, indemnifying the applicant in the sum of at least $100,000 for injury or death to one person and $300,000 for injury or death for more than one person in any one accident and $100,000 for property damages in any one accident arising out of the operation of the applicant's business. The policy of insurance so deposited shall contain a clause obligating the company insuring the same to give at least 10 days' written notice to the City Building Official before cancellation or expiration thereof. The license for the operation of said applicants shall expire upon the lapse or termination of said policy. A certification of insurance shall be filed with the City annually to indicate that the policy is effective.

After proper application for license, favorable endorsement of the City Building Official as designated in § 5-1989 of this article or favorable endorsement of the City Engineer as designated in § 5-91 of this article and favorable action by the Board of City Commissioners granting such license, and payment of the license fee, the City Building Official shall issue a license to engage in or conduct the business of plumbing to the person making application for same.

The license fee for plumbers shall be established by resolution by the Board of City Commissioners. All plumbing licenses shall expire the first day of March of each year.

Each licensed plumber and sewer and water installer shall be furnished each year with a license card by the City and such identification shall be carried on his person at all times.

No person licensed to carry on the business of plumbing or to do any work on the City sewers or water mains shall allow his name to be used by any other person for the purposes of obtaining any permits or doing any work under the license and every person shall have recorded in the office of the building official his place of business and the names of all persons employed by him.

If a master or journeyman plumber or sewer and water installer fails to renew his license within 30 days of the date of expiration, it shall be necessary to make application through the regular procedure stated in this division and pay the initial fee again.

The Board of City Commissioners shall have the right to revoke any annual license issued by the City in case of violation of any of the ordinances, rules and regulations governing plumbing, sewers, water mains and house plumbing in the City.
