For the purposes of this article the following terms, phrases,
words and their derivations shall have the meaning given herein:
Shall be a point of stoppage to load or unload property being
transported and to be delivered or picked up at that point.
Is a truck which leaves and departs from a truck route while
traveling inside the City.
Is any motor vehicle designed, used or maintained primarily
for the transportation of property and, for the purposes of this article,
whose body weight or whose combined body and load weight exceeds 20,000
pounds registered gross weight.
Is a way over certain streets, as designated in this article,
over and along which trucks coming into and going out of the City
must operate.

All trucks within the City shall be operated only over and along
the truck routes established in this article or otherwise permitted
in this article. Trucks operated by the City or used for municipal
services are excluded from this restriction.

The City auditor shall keep and maintain accurate maps setting
out truck routes and streets upon which truck traffic is permitted;
the maps shall be kept on file in the office of the City auditor and
shall be available to the public.

The chief of police shall cause all truck routes and those streets
upon which truck traffic is prohibited to be clearly signposted to
give notice that this article is in effect.

The chief of police shall have the authority to require any
person driving or in control of any commercial vehicle not proceeding
over a truck route or street over which truck traffic is permitted
to proceed to any public or private scale available for the purpose
of weighing and determining whether this article has been complied
with.

Any person who violates this article shall be punished by a
fine of $500 for each such offense. This offense is classified as
an infraction.

(a)
This article shall not prohibit:
(1)
Operation on street of destination. The operation of a truck
on any street or alley where necessary to the conduct of business
at a destination point, provided streets designated as truck routes
are used until reaching the intersection nearest the destination point.
(2)
Emergency vehicles. The operation of emergency vehicles upon
any street in the City.
(3)
Public utilities, etc. The operation of trucks owned or operated
by the City, public utilities; any contractor or material man while
engaged in the repair, maintenance or construction of streets, street
improvements or street utilities within the City.
(4)
Detoured trucks. The operation of trucks upon any officially
established detour in any case where such truck could lawfully be
operated upon the street for which such detour is established.
(5)
Loading or unloading. The operation of a truck for the purpose
of loading or unloading any cargo or part of cargo, provided that
streets designated as truck routes in this article are used until
reaching the intersection nearest the destination point.

Service or repair. The operation of a truck for the purpose
of having such truck serviced or repaired.

(a)
One inside destination point. All trucks entering the City for a
destination point in the City shall proceed only over an established
truck route and shall deviate only at the intersection with the street,
upon which such traffic is permitted, nearest to the destination point.
Upon leaving the destination point, a deviating truck shall return
to the truck route by the same route.
(b)
Multiple inside destination points. All trucks entering the City
for multiple destination points shall proceed over only established
truck routes and shall deviate only at the intersection with the street,
upon which such traffic is permitted, nearest to the first destination
point. Upon leaving the first destination point, a deviating truck
shall proceed to other destination points by the shortest direction
and only over streets upon which such traffic is permitted. Upon leaving
the last destination point, a deviating truck shall return to the
truck route by the shortest permissible route.

(a)
Outside destination point. All trucks, on a trip originating in the
City, and traveling in the City for a destination point outside the
City, shall proceed by the shortest direction over streets on which
such traffic is permitted to a truck route as established in this
article.
(b)
Inside destination points. All trucks, on a trip originating in the
City, and traveling in the City for destination points in the City,
shall proceed only over streets upon which such traffic is permitted.

Trucks making more than one delivery on any one trip may take
the most direct route between one delivery and the next.

(1)
There are hereby established within the City the following truck
routes to provide cross-town traffic for U.S. Highway 2 & 85 and
N.D. Highway 1804, as well as a local truck route to provide cross-town
traffic for local businesses established within the vicinity of the
City.
U.S. Highway 2 & 85 Truck Route: Begins at the intersection
of 42nd Street and North U.S. Highway 2 & 85 and proceeds south
along U.S. Highway 2 & 85 and the West Dakota Parkway (known as
the West By-Pass) to the west City limits.
N.D. Highway 1804 Truck Route: Begins at the intersection of
27th Avenue East and N.D. Highway 1804 and proceeds west along N.D.
1804 (also known as East Broadway) to 7th Avenue East; then south
two blocks onto 1st Street; then west along 1st Street to 2nd Avenue
West; then north one block to 2nd Street West; thence west on 2nd
Street West to the west City limits and connection to U.S. Highway
2 & 85.
Local Truck Route (known as East Dakota Parkway & 26th Street):
Begins at the intersection of 2nd Avenue West and 26th Street and
proceeds east along 26th Street to East Dakota Parkway (known as East
By-Pass); then south along East Dakota Parkway to the intersection
of East Broadway and connection to N.D. Highway 1804 truck route.
(2)
The City public works director shall have the authority to place
temporary restrictions upon the use of the local truck route when,
in the director's discretion, such restrictions are necessary to prevent
damage to the roads.
