Pursuant to N.D.C.C. § 40-48-01 et seq., there is hereby created a body to be known as the "Planning Commission of the City of Williston," referred to in this article as the "planning commission."

The planning commission shall consist of 12 members: 10 from the city and two appointed by the county commissioners of the county.

The two members of the planning commission appointed by the county commissioners shall hold office, one for five years and the other for three years, and thereafter such members shall hold office for a term of five years.

(a) 
The president of the board of city commissioners shall appoint seven members of the planning commission to be approved by such board, who shall be residents of the city. There shall be appointed at the expiration of the term of each member as aforesaid a member for a term of five years.
(b) 
Three of the members, the executive officer (president of the board of city commissioners), the city engineer and the city attorney, shall be ex officio members and shall serve during and for their respective terms for which they are elected or appointed.

(a) 
The president of the board of city commissioners shall submit to the board of city commissioners, at the next meeting after making appointments to the planning commission, the names of the persons appointed and the length of their terms. The board of city commissioners shall, by a majority vote, confirm or reject such appointments.
(b) 
If such appointments or any of them are rejected, the president of the board of city commissioners shall make other appointments for such appointees as may be rejected, which appointments shall be approved or rejected in like manner.

The members of the planning commission appointed as provided in this article shall take office immediately upon confirmation of their appointment and qualifying, and shall organize and hold regular meetings in the City Hall.

The planning commission shall have such powers and perform such duties as may now or hereafter be provided for by law. All members of the planning commission shall serve as such without compensation and, when duly authorized by the commission, may be allowed reasonable traveling expenses incidental to attending planning conferences or meetings of planning institutes or hearings upon pending planning legislation.

The planning commission appointed under this article shall act ex officio as a body to be known as the zoning commission of the city, to recommend the boundaries of the various original zoning districts and appropriate regulations to be enforced therein and make a preliminary report and hold public hearings thereon before submitting its final report.

The planning commission shall exercise jurisdiction over the planning and zoning of the entire city and the territory added by this article, subject only to final action taken by the board of city commissioners.

The jurisdiction of the planning commission shall be extended up to one mile in any direction from the present city limits as shown on the map attached to the ordinance from which this section is derived and made a part thereof by reference, none of which is incorporated territory.
