The City of Williston's jurisdiction extends to all persons,
places and property within its boundaries and such extraterritorial
jurisdiction as is granted to it under the provisions of the law of
the state, and it was the decision of the Board of Commissioners for
the City of Williston to avail itself of the authority granted municipalities
by Section 40-47-01.1, N.D.C.C., and
In the year 2010 the City of Williston had a population of 14,716
according to the last federal census, and
The City of Williston has a Planning and Zoning Commission also
empowered to act as and to be known as a Zoning Commission, and
The boundaries of the City of Williston have recently been expanded
due to property annexed into the City, and
The City of Williston duly notified the zoning board or boards
of all political subdivisions losing their partial zoning authority
14 days prior to the City's adoption of this ordinance (Ordinance
No. 1017) in accordance with Subsection five of Section 40-47-01.1,
N.D.C.C., in which a zoning transition meeting was held and addressed
and reviewed the existing zoning rules, regulations and restrictions
currently in place for the territory to be extraterritorially zoned
and to plan for an orderly transition, and
The Zoning Commission has submitted its recommendations to the
Board of City Commissioners in the form of a preliminary and final
report after holding public meetings thereon recommending the expansion
of the City's extraterritorial jurisdiction for exclusive jurisdiction
as provided in Subsection 1(a)(2) of Section 40-47-01.1, N.D.C.C.,
and
The land to be zoned and controlled by the City of Williston
is a large area where extensive planning is required so development
within the area will be done to maximum potential, and planning of
this magnitude necessitates intensive study of long duration before
final zoning regulations can be imposed, and
It is the intent of the City Commission that this interim zone
classification be in all respects a zone classification no less than
the other classifications heretofore enacted by this body within the
Ordinance No. 613, also known as Planning and Zoning Ordinance, with
all amendments thereto.

The City of Williston hereby extends the application of its
zoning regulations to include all of the following described in Williams
County, North Dakota, more particularly described in the attached
Exhibit A.

The regulations set forth in this article or set forth elsewhere
in the zoning ordinances when referred to in this article, are the
regulations in the interim zone district within the territory embraced
by a one mile extension of the boundaries to the city.

(a) A building or premises shall be used only for the following purposes:
(1)
Agricultural buildings including farm dwellings, but not including
any business that would add to the value of the agricultural product
by any processing or feeding operation, other than that which is a
necessary accessory use, providing that the accessory use remain secondary
to normal agricultural activities.
(2)
Parks, playgrounds, recreation areas and facilities, community
centers.
(3)
Public school, elementary or high or a private school having
a curriculum the same as ordinarily given in a public school.
(4)
Country club or golf courses, except miniature courses or practice
driving tees operated for commercial purposes.
(5)
Churches, or other places of worship or Sunday School.
(6)
Sale of nursery and greenhouse products.
(7)
Riding academies and public stables, providing that storage
of manure shall not be permitted nearer than 150 feet to any lot line.

All of the ordinances pertaining to the erection, construction,
enlargement, alteration, repair, moving, removal, demolition, conversion,
occupancy, equipment, use, height area and maintenance of buildings
or structures within the city shall apply to the interim zone district
and shall be enforced within the interim zone district in the same
manner as it is enforced in the city.

The building inspector shall administer and enforce this article,
including the receiving of applications, the inspection of premises
and the issuing of all permits. No permit shall be issued by him except
where the provisions of this article have been complied with.
