Notwithstanding the provisions of §§ 20 and 23
of the Town Law and § 3 of the Public Officers Law, the
residency requirements within this article shall apply.
For those officers, including directors and deputies, with an
on-call component of their duties (for example, including, but not
limited to: Director of Building and Fire Prevention, Fire Marshal,
Director of Information Technology, Commissioner of Public Works,
and Superintendent of Highways), unless a more-restrictive requirement
is set forth within this article, such individual(s) shall reside
within the fifteen-mile radius of Henrietta Town Hall.
For those officers, including directors and deputies, without
an on-call component of their duties (for example, including, but
not limited to: Town Clerk, Deputy Town Clerk, Director of Engineering
and Planning, Director of Finance, Town Assessor, Library Director,
Recreation Director, Parks and Recreation Director, Town Attorney,
and Marriage Officer), unless a more-restrictive requirement is set
forth within this article, such individual(s) shall reside either
within Monroe County or otherwise within the twenty-five-mile radius
of Henrietta Town Hall.
For those officers holding an elected position (e.g., Town Supervisor,
Town Board member), holding a position as a member of either the Planning
Board or the Zoning Board of Appeals, or holding the position of Deputy
Town Supervisor, notwithstanding the other provisions herein, the
New York state law requirement that such individual shall reside within
the Town of Henrietta shall apply.
For those individuals that are members of the advisory boards
and/or committees (e.g., the Conservation Board, Ethics Board, Historic
Site Committee), notwithstanding the other provisions herein, such
individuals shall reside within the Town of Henrietta, except that
where the Board's rules, bylaws or establishing legislation require
an existing Town officer to be a member of such Board, less-restrictive
residency requirements for such Town officer as otherwise set forth
herein shall supersede the residency requirements for such advisory
Board.
Where civil service requirements for a position would otherwise
further limit residence (e.g., where a position requires the individual
be a Monroe County resident in order to take a required test), such
requirements shall supersede the provisions herein where otherwise
inconsistent.
