This Part is being adopted in order to maintain the health,
safety, cleanliness, and aesthetics of the Township. It is also intended
to prevent dangerous conditions and eliminate nuisances within the
Township.

As used in this Part, the following terms shall have the meanings
indicated:
COMMERCIAL TRASH BIN (THE BIN)
Any container used for the disposal of waste, garbage, refuse,
or construction materials, that is movable, emptied and hauled away
using specialized equipment. The term includes any container measured
in cubic yards and larger than a standard size trash receptacle (a
fifty-five-gallon drum or its equivalent).

1. The use of a bin for primary storage or for disposal of household
waste on a property, whose primary use is residential (a "residential-use
property" or "property"), is prohibited except in the following circumstances:
A. Permitted Uses; Requirements.
(1)
The use of a bin is permitted on a residential-use property
for the removal of trash or debris not normally associated with common
household activities. The allowable use may be but is not limited
to property cleanup, home renovation or construction, or an emergency
situation due to fire, flood, storm or other situation that requires
the use of a bin for cleanup.
(2)
The bin must have the name and phone number of the bin owner
clearly visible on at least one outside panel. The bin must have a
serviceable lid that shall remain closed when not in use.
B. Restrictions and Prohibitions.
(1)
The use of a bin on residential-use properties is limited to
a thirty-day period no more than twice in any calendar year. This
period of time may be extended at the discretion of the Zoning Officer
upon good cause shown.
(2)
If a bin is on a property in violation of this section, the
Zoning Officer has the authority to have the bin removed by its owner
or other qualified vendor, at the property owner's expense even
if the bin is not properly marked as to its ownership. The Zoning
Officer shall provide a written notice to the residential property
owner at least seven days prior to taking any action hereunder.
(3)
No bin may be used for waste, trash or rubbish not generated
from the property on which it is located.
(4)
No hazardous materials, as defined in §
27-201 of the Sugarloaf Township Code of Ordinances, may be placed in any bin.
(5)
No waste, trash or rubbish may be left on the ground surrounding
the bin.
(6)
No bin shall emit foul odors detectable outside the property
upon which it is located or contain decomposing organic materials
that may putrefy.
C. Permits; Fees; Placement of Bins.
(1)
Prior to placing a bin on a residential-use property, the property
owner must notify the Zoning Officer and complete and file a form
containing information on the property location, owner, and dates
when the bin will be on the property. A property owner must obtain
the appropriate permit and pay the necessary fee prior to placement
of a bin on a property.

Any bin placed on a property must be at least 10 feet from any
structure.

1. The use of bins on a commercial- or industrial-use property is permitted
under the following regulations:
A. Requirements.
(1)
Bin(s) must have a serviceable lid that shall be closed when
not in use.
(2)
Bin(s) must be placed in a clean, safe, and sanitary location on the property and are subject to the requirements of Chapter
22, Subdivision and Land Development, of the Code of Sugarloaf Township (as determined the Sugarloaf Township Code Enforcement).
(3)
Bin(s) must be surrounded on three sides by opaque screening
that is at least as high as the bin.
(4)
Every bin must have the bin owner's name and phone number clearly
visible on at least one outside panel.
(5)
No waste, trash, or rubbish shall be left on the ground surrounding
the bin.
(6)
Bin(s) shall not be located in the front yard setback of the
property.
B. The property owner is responsible for maintaining the bin according
to this Part.
C. In the event bin(s) are not maintained according to this Part, the
Zoning Officer, upon written notice of at least seven days to the
property owner, may have the bin(s) emptied at the property owner's
expense, by the bin owner or other qualified vendor.

This Part applies to any newly placed bin as well as existing
bins.

There is no fee for the placement of bin(s) on any property.

This Part is enforceable by the Zoning Officer of Sugarloaf
Township.

All other ordinances or parts of ordinances inconsistent herewith
are hereby repealed.

Any person, business or corporation who violates any provision of this Part shall be subject to the penalties listed in §
27-804 of the Sugarloaf Township Ordinances.
