As used in this chapter, the following terms shall have the
meanings indicated:
PERSON
Any natural person or persons, association, partnership,
firm or corporation.
No person shall cause or permit any driveway, street, road or
other entrance to be connected to any Township street or highway without
first having obtained a permit therefor; nor shall any person cause
or permit any driveway, street, road or other entrance to be constructed
in a manner other than that approved pursuant to a permit issued by
the Township of Newberry.

Application for a permit to connect any driveway, street, road
or other entrance to a Township street or highway shall be made to
Newberry Township, by filing an application upon a form approved by
the Township, and shall be accompanied by the submission of plans
or drawings and by the payment of a fee as set by resolution of the
Board of Supervisors.
No permit for the connection of any driveway, street, road or other entrance to a Township street or highway shall be issued unless the proposed driveway, street, road or other entrance connection, as shown on the plans or drawings submitted with the application, complies with the applicable provisions of §§
344-27 and
344-28 of Chapter
344, Subdivision and Land Development, which provisions are incorporated herein and made a part of this chapter.
Upon completion of any work authorized by the Township permit,
the holder of such permit shall report to the Township Secretary by
letter within five days from the date of said completion. Such work
shall not be considered as completed or approved until such work has
been inspected and approved by the Newberry Township Superintendent
of Roads, or his designated agent; provided that such inspection shall
be made within 10 days of receipt of the permit holder's notice of
completion.
If any work authorized by any permit issued pursuant to this
chapter shall not have been commenced within six months after the
issuance of such permit, such permit shall become null and void and
the permit holder shall relinquish such unused permit to the Township.
The permit fee paid for any permit subsequently relinquished shall
not be returned nor applied toward any future permit.

Any person who shall violate any of the provisions of this chapter
shall, upon being found liable therefor in a civil enforcement proceeding
commenced by Newberry Township, pay a fine not exceeding $600 plus
all court costs, including reasonable attorney's fees, incurred by
Newberry Township. Newberry Township police officers, the appropriate
Code Enforcement Officers of Newberry Township or other appropriate
officer or officers of Newberry Township shall have the power to enforce
the provisions of this chapter. The amount of the fine imposed for
the violation of this chapter shall be established by the officer
who determines that a violation has occurred. Notice of the violation
of this chapter and the amount of the fine imposed shall be given
by personal delivery or by certified mail to the person violating
this chapter. If the person violating this chapter fails or refuses
to pay the fine imposed within the period specified in the notice
of the violation of this chapter, the Township shall file a civil
enforcement proceeding with the Magisterial District Judge to enforce
the fine imposed.
