It is hereby declared to be the public policy of the County and in the best interests of the public health and welfare of the citizens to adopt this article in order to encourage, promote, and facilitate the recycling of waste tires in the County.

Unless other times, methods or locations are specifically established by the Board of Supervisors or the County Administrator and posted on the County website, advertised in the newspaper, or otherwise publicized, then all waste tires deposited for recycling by the County pursuant to this article shall be deposited at the County landfill at a scheduled time agreed to by the County Department of Environmental Management when County personnel are present to accept the tire(s) and payment therefor. "County landfill" means the state-permitted municipal solid waste landfill located at 20221 Maplewood Road, Jetersville, Virginia, commonly referred to as the "Maplewood Landfill."
The Board of Supervisors may, in its discretion, establish periods during each calendar year during which County citizens, businesses and other organizations may drop off tires for recycling by the County for no charge.
A. 
In order to help defray the costs of administering this program, the initial tire recycling fees shall be as follows:
(1) 
Passenger vehicle: $2 per tire.
(2) 
Tractor trailer/oversized: $5 per tire.
(3) 
Large agricultural (tractor) tires: $25 per tire.
B. 
The Board of Supervisors may from time to time adopt by resolution or motion a different fee schedule as deemed appropriate by the Board.
A. 
Individuals covered by this article. Only individual residents of the County, including County businesses and other locally owned or operated organizations and entities, shall be authorized to recycle tires with the County as provided by this article. Anyone dropping off tires for the County to recycle shall provide proof, upon request of the County or its agent, of individual County residence or proof that the business or other organization is located in the County.
B. 
Tires covered by this article. This article shall apply to all types of waste tires, including individual passenger and commercial tires, tires used for business or agricultural use, etc. However, the County Administrator or his designee may establish different procedures for the disposal and recycling of different classes of tires.
Any person violating any of the provisions of this article shall be deemed guilty of a Class 4 misdemeanor and upon conviction thereof shall be punished by a fine not exceeding $250. Each day of violation of any provision of this article shall be a separate offense.
In the event of a direct conflict between this article and Article I of this chapter or any other County ordinance, this article shall control.
