[Adopted as Art. 1, Chs. 200, 300 and 600, of the General Bylaws]
A. 
As used in these bylaws, the following terms shall have the meanings indicated:
CHARTER
The Longmeadow Home Rule Charter, described in § 1-2, together with any and all amendments thereto.
COMMONWEALTH
The Commonwealth of Massachusetts.
DEPARTMENT
Includes an officer, board, committee and commission.
HEAD OF DEPARTMENT
The person who has responsibility for supervision of the day-to-day activities of the department.
OCCUPANT
As applied to a building or to land, includes a person who occupies the whole or a part of a building or land, either alone or with others, regardless of whether the person occupies the building or the land as a tenant or as an owner.
OFFICER
Includes a person who is elected at the Annual Town Election and a person who is a head of a department.
OWNER
As applied to a building or to land, includes a part owner, joint owner, tenant in common, joint tenant, and tenant by the entirety of the whole or of a part of the building or the land.
PERSON
Includes a corporation, an unincorporated business entity, a partnership, and a joint venture.
STREET
Includes a public way, highway, Town way, alley, square, lane, court, crossroad, sidewalk, and a part of a public place that forms a traveled part of a highway or public way.
TOWN MANAGER
That person who is the chief administrative officer of the Town who is responsible to the Select Board and for the proper administration of all Town affairs assigned to the Town Manager under the Charter: Home Rule Charter Section 5-2.
VOTE OF THE TOWN
Includes a vote on an issue that is taken at a meeting of the Town at which a quorum is present and a vote of eligible voters in a Town election.
B. 
Charter terms. Terms appearing in the Charter and also appearing in these bylaws shall have the meaning ascribed to them in the Charter.
A. 
Singular and plural; gender. A word in the singular includes the plural, and a word in the plural includes the singular. Words importing the masculine gender shall include the feminine gender, and words importing the feminine gender shall include the masculine: Home Rule Charter Section 8-6.
B. 
Severability. The provisions of any bylaw are severable. If any provision of a bylaw is held invalid, the other provisions of the bylaw shall not be affected. If the application of a bylaw or any of its provisions to any person or circumstance is held invalid, the application of the bylaw and its provisions to other persons and circumstances shall not be affected.

C. 
Construction. Subsection A of this section does not apply to a provision of these bylaws if application of the subsection creates a meaning that is inconsistent with, or repugnant to, the context in which the need for interpretation exists.
D. 
Specific provisions. If any specific provision of a bylaw conflicts with any provision expressed in general terms, the specific provision shall prevail: Home Rule Charter Section 8-3.
E. 
Relation to Massachusetts General Laws. If a conflict exists between a provision in these bylaws and a provision in the General Laws of the Commonwealth, the provision in the General Laws is the controlling provision.
F. 
Relation to Charter. If any conflict exists between a provision in these bylaws and a provision in the Charter, the provision in the Charter is the controlling provision.
These bylaws do not affect any act that has been done, any right that has accrued, any penalty that has been incurred, any suit, prosecution or proceeding that is pending, or the tenure of office of a person who holds office at the time that these bylaws take effect.
