This chapter shall be known and cited as the "City of Havre de Grace's Site Plan Regulations." The site plan regulations shall include the text, graphics and regulations, and any amendments thereto.
The site plan review provisions set forth in this chapter are intended to protect the public health and safety and promote the general welfare of the community. These provisions are also intended to ensure that development is designed and constructed in a manner which assures that adequate provisions are made for traffic safety and access; emergency access; water supply; sewage disposal; stormwater management; erosion and sediment control; protection of environmentally sensitive areas; minimizing the adverse impacts on adjacent properties; and ensuring development preserves the context and fabric of the historic City of Havre de Grace.
A. 
These regulations govern all areas within the municipal limits of Havre de Grace. It shall be unlawful to establish a use of any parcel unless the use is in compliance with the terms of this chapter, or is expressly exempted herefrom.
B. 
The Planning Commission shall have control over site plan approval and ensuring that the development of any parcel is in compliance with the terms of this chapter, unless otherwise provided in this chapter.
This chapter shall be administered, interpreted and enforced by the Director of the Department of Planning. If the Director finds that any provision of this chapter is being violated, they must notify the person responsible for such violation in writing, indicating the nature of the violation and ordering the action necessary to correct it. The Director must order the discontinuance of the illegal use of buildings or structures, or work being commenced without the appropriate approvals and permits. The Director is authorized to take any other action to ensure compliance with the City Code, or to prevent violation of its provisions.
Unless otherwise stated herein, definitions shall be per § 205-13 (Definitions) of the City Code, as amended.
