This article shall be known as "Local Law No. 3-2020" and entitled
"Dead or Diseased Trees on Private Property."
The purpose of this article is to allow entry onto private property
to cut trees that endanger the public life and property within the
Town of Sardinia.
The Highway Superintendent shall have the right to cause the
removal of any dead or diseased trees on private property within the
Town when such trees constitute a hazard to public life or property
or harbor insects or disease which constitute a potential threat to
other trees within the Town. The Highway Superintendent will notify
the owner(s) of such trees in writing. Removal shall be done by such
owner(s) at their expense within 60 days after the date of service
of notice. In the event of failure of the owner(s) to comply with
such provisions, the Highway Superintendent shall have the authority
to remove such trees and charge the cost of removal on the owner's
property tax notice. Where the Town is required to remove a tree for
waterway maintenance purposes, the cost shall not be charged to the
owner of the property.
All ordinances, local laws and parts thereof inconsistent with
this article are hereby repealed.
This article shall take effect immediately upon filing in the
office of the New York State Secretary of State in accordance with
the Municipal Home Rule Law.
