[1973 Code § 1:4-1]
The Township of Green Brook does hereby adopt the provisions of Subdivision B of Article
I, Chapter
3 of Title 26 of the Revised Statutes of New Jersey, pertaining to local boards of health.

There is hereby continued, pursuant to New Jersey Revised Statutes
26:3-1, et seq., as amended and supplemented, a Board of Health of
the Township, which shall consist of seven members, who shall be citizens
and residents of the Township, who shall be appointed by the Township
Committee.

Six members of the Board of Health shall serve for terms of
three years each, so that each year the terms of two of the six members
shall expire. The seventh member of the Board of Health, who shall
be a full voting member of the Board, shall be a member of the Township
Committee, and shall be appointed for a term of one year; provided,
however, that resignation from the Township Committee shall also constitute
resignation from the Board of Health.

If any vacancy shall occur on the Board of Health, it shall
be filled in the same manner in which the original appointment was
made, but for the unexpired portion of the term only.

The Township Committee shall appoint two alternate members to
the Board of Health who shall have the right to attend all meetings
of the Board and participate in discussions of any proceedings, but
may not vote except in the absence or disqualification of a regular
member. A vote shall not be delayed in order that a regular member
may vote instead of an alternate member. In the event that a choice
must be made as to which alternate member is to vote, Alternate No.
1 shall vote first. Said alternate members shall be designated at
the time of appointment by the Mayor as Alternate No. 1 and Alternate
No. 2. Such alternate members shall serve for a term of two years,
except that the terms of the alternate members first appointed shall
be two years for Alternate No. 1 and one year for Alternate No. 2,
so that the term of not more than one alternate member shall expire
in any one year. A vacancy occurring other than by expiration of term
shall be filled by the Mayor for the unexpired term only.

There exists along the Green Brook and its tributaries certain
problems of flooding and flood prevention which concern several municipalities
and three counties, as well as other governmental bodies.
The various governmental units affected by such drainage basin
recognize the need for cooperation efforts to prevent future floods
and to alleviate flooding and flood hazards.
Chapter 316, P.L. 1971 (N.J.S.A. 40:14-16), authorizes the establishment
of a joint Flood Control Commission and provides that the participating
municipalities and counties may enter into such a Commission and may
define and limit the areas of responsibility and authority of such
a Commission, and may set forth the terms under which appropriations
shall be made by the participating municipalities and counties.

The Township of Green Brook in the County of Somerset, State
of New Jersey, agrees to participate in the creation of and operations
of the Green Brook Flood Control Commission, pursuant to Chapter 316,
P.L. 1971, as follows:
a. The municipalities and counties invited to participate in the Commission
are: Borough of Bound Brook, Township of Bridgewater, Borough of Dunellen,
Township of Green Brook, Borough of Middlesex, Borough of North Plainfield,
City of Plainfield, Township of Scotch Plains, and the Borough of
Watchung, and the County of Middlesex, County of Somerset, and County
of Union.
b. The Green Brook Flood Control Commission shall be established in
accordance with Chapter 316, P.L. 1971 of the State of New Jersey.
c. The Green Brook Flood Control Commission shall:
1. Collect, study and analyze data on flooding, past floods and the
causes of floods in the area;
2. Make such data and studies available to the participating members,
to the Division of Water Policy and Supply, the Army Corps of Engineers,
local and County Planning Boards and officials concerned with subdivisions
and development of properties within the floodway and drainage areas;
3. Keep itself informed as to the availability of State and Federal
funds and grants, and the procedures for applying therefor, and shall
make such information available to participating members;
4. Coordinate the activities of the participating members relating to
flooding, flood prevention, brook cleaning and the like;
5. Encourage the acquisition of lands within the floodway and low-lying
areas by appropriate County Park Commissions, counties or participating
municipalities;
6. Publicize methods of flood control and flood prevention;
7. Encourage its participating members and others, to adopt appropriate
ordinances and regulations relating to flood control;
8. Encourage its participating members to support other programs designed
or intended to alleviate flooding;
9. Perform such other acts and fulfill such other functions as may be
permitted by law and as determined by the members, subject to the
limitations in this agreement and subject to the limitations as set
forth in Chapter 316, P.L. 1971.
d. Appropriations.
1. The general, administrative and other expenses of the Commission,
affecting the Commission as a whole, shall be apportioned among the
members as follows:
(a)
One-fourth thereof to be apportioned among the member counties
as follows: Middlesex County, 4.2%; Somerset County, 12.5%; and Union
County, 8.3%.
(b)
Three-fourths thereof to be apportioned among the member municipalities,
according to a formula taking into account population and frontage
along the brook, and resulting in the following:
Bound Brook, 3.65%; Bridgewater, 8.75%; Dunellen, 2.95%; Green
Brook Township, 6.0%; Middlesex Borough, 9.65%; North Plainfield,
11.05%; Plainfield, 17.95%; Scotch Plains, 7.05%; and Watchung, 17.95%.
In the event any of the foregoing municipalities do not join, the
formula used to obtain the foregoing percentages shall be re-applied
to determine the apportionment among the remaining and participating
municipalities.
2. Whenever a specific project is to be undertaken, involving less than
the interest of all of the participating members, or of special benefit
to less than all of the participating members the apportionment of
the costs thereof shall be agreed upon by the participating members
specially benefited thereby in advance of authorization of such project.
3. The apportionments set forth herein may be changed by agreement among
the participating municipalities and counties, provided, however,
that there shall be no increase in the percentage to be contributed
by any participant in the expenses set forth in subparagraph 1 above,
without the consent of the governing body of such participating members.
e. Budget. The tentative annual budget for the Commission shall be adopted
by the Commission no later than January 15 of each year and such adoption
shall be by a vote of at least three county representatives (regardless
of the total number of counties represented thereby), and at least
nine municipal representatives (regardless of the total number of
municipalities represented thereby). A copy of such tentative budget
shall be sent to the governing body of each of the participating counties
and municipalities within one week of the adoption thereof. Such notice
shall include notification of the date fixed by the Commission for
final adoption of such budget, which shall be at least three weeks
after the date of tentative adoption by the Commission.
Expenditures outside the regular budget for special projects
involving two or more of the participating member counties or municipalities
(but less than the entire Commission) shall be negotiated and arranged
separately among the involved participating members and the Commission.
f. Quorum. Any number of members of the Commission shall have the right
to meet at regularly scheduled meetings. Any action taken involving
the expenditure of funds, other than clerical and mailing connected
with the usual business of the Commission, shall be adopted only at
a meeting at which there are at least three county representatives
(regardless of the total number of counties represented thereby) and
at least nine municipal representatives (regardless of the total number
of municipalities represented thereby).
g. Withdrawal. Each member municipality and county reserves the right,
pursuant to Section 2d of Chapter 316, Laws of 1971, to withdraw from
the Commission, provided, however, that at least 90 days' notice
of such intention is given to the Commission, and provided, further,
that such withdrawal after the adoption of the Commission budget for
a given year shall not abrogate the responsibility of the municipality
or county to meet its obligations under the budget for such year.

a. The Township Committee shall appoint two representatives to the commission;
either or both of the representatives may be a member of the Township
Committee or hold other elective or appointive office in the Township.
b. In addition to such representatives, the Township Committee may appoint
two alternate representatives to the Commission, who shall serve for
the terms of one year each, or until the appointment and qualification
of their successors. Such alternates shall have the right to attend
all meetings of the Commission and take part in all discussions. The
alternates shall be designated as first alternate and second alternate
and in such order may represent the Township and vote in the event
or the absence or disability of one or both of the regular representatives.
c. Each regular representative shall serve for a term of five years,
or until his successor has been appointed and has qualified, except
that any appointed representative who holds another elected or appointed
public office shall serve as such representative for the term of his
elected or appointed office and only so long as he shall hold such
elected or appointed public office, notwithstanding his term of appointment
as such representative. Appointments to vacancies caused by the death,
resignation or other inability to serve of a representative shall
be filled for the balance of the term only. No alternate representative
shall automatically succeed to a regular representative position upon
a vacancy occurring in a regular position.

There is hereby established in and for the Township, an Environmental
Commission, pursuant to New Jersey Statutes 40:56A-1, et seq., for
the protection, development or use of natural resources, including
water resources, located within the Township.

a. The Environmental Commission shall consist of seven members, appointed
by the Mayor.
b. At least one member of the Environmental Commission shall also be
a member of the Planning Board.
c. All members shall be residents of the Township.
d. The Mayor shall designate one of the members of the Commission to
serve as chairman and presiding officer.
e. The terms of office of the first commissioners shall be for one,
two, or three years, to be designated by the Mayor in making his appointments
so that the terms of approximately 1/3 of the members will expire
each year (but so designated so to expire on December 31 of each year
so designated). Their successors shall be appointed for terms of three
years and until the appointment and qualification of their successors.
f. Removal. The Township Committee may remove any member of the Commission
for cause, on written charges served upon the member and after a hearing
thereon at which the member shall be entitled to be heard in person
or by counsel.
g. Vacancy. A vacancy on the Commission occurring otherwise than by
expiration of a term shall be filled for the unexpired term in the
same manner as an original appointment.
h. The members appointed to the Commission may be members of other municipal
boards or agencies, and one may be a member of the Township Committee.
i. Pursuant to the authorization of N.J.S.A. 40:56A-1, the Township
Committee is hereby authorized to appoint one alternate member to
the Environmental Commission. Any such appointment shall be for a
term of two years, as set forth in the statute, and the alternate
so appointed shall have the duties as set forth in the statute.

The Environmental Commission shall have the power to conduct
research into the use and possible use of the open land areas of the
Township and may coordinate the activities of unofficial bodies organized
for similar purposes, and may advertise, prepare, print and distribute
books, maps, charts, plans and pamphlets which in its judgment it
deems necessary for its purposes. It shall keep an index of all open
areas, public or privately owned, including open marshlands, swamps
and other wetlands, in order to obtain information on the proper use
of such areas, and may recommend to the Planning Board and the Township
Committee, plans and programs for inclusion in the Master Plan and
the development and use of such areas.

The Environmental Commission may, subject to the approval of
the Township Committee, acquire property, both real and personal,
in the name of the Township by gift, purchase, grant, bequest, devise
or lease for any of its purposes and shall administer the same for
such purposes subject to the terms of the conveyance or gift. Such
an acquisition may be to acquire the fee or any lesser interest, development
right, easement (including conservation easement), covenant or other
contractual right (including a conveyance on conditions or with limitations
or reversions), as may be necessary to acquire, maintain, improve,
protect, limit the future use of, or otherwise conserve and properly
utilize open spaces and other land and water areas in the Township.

The Environmental Commission shall keep records of its meetings
and activities and shall make an annual report to the Township Committee.

a. The Township Committee may appropriate funds for the expenses of
the Commission.
b. The Environmental Commission may appoint such clerks and other employees
as it may require and as shall be within the limits of funds appropriated
to it.
c. Notwithstanding any powers herein granted to the Commission, it shall
not obligate itself or attempt to obligate the Township beyond the
limits of any appropriation made to it, or other funds which may be
donated to it or otherwise available to such Commission.

The Environmental Commission shall have power to study and make
recommendations concerning open space preservation, water resources
management, air pollution control, solid waste management, noise control,
soil and landscape protection, environmental appearance, marine resources
and protection of flora and fauna.

There is hereby established in the Township a Recreation Committee,
which shall have the duties and powers hereinafter set forth, the
members of which shall be appointed by the Township Committee in accordance
with the provisions of this section.

The Recreation Committee shall be composed of nine members,
who shall be citizens and residents of the Township. Three of the
members first appointed shall hold office for a term of three years,
three members shall hold office for a term of two years, and the remaining
three members shall hold office for a term of one year, so that the
Committee shall be constituted so that the terms of three members
shall expire each year; thereafter all appointments shall be for a
term of three years. Vacancies shall be filled for the unexpired term
only. The members shall serve until their respective successors are
appointed and qualify. The members shall receive no compensation for
their services. No person shall be ineligible for appointment to the
Recreation Committee by reason of holding any office, appointment
or employment in the Township of Green Brook. The Township Committee
member who serves as Chairperson of the Department of Building and
Grounds shall be an ex officio member of the Recreation Committee
but shall have no vote unless such person also be formally appointed
as a member of the Recreation Committee.

a. The Township Committee shall cooperate with the Recreation Committee
to coordinate recreational activities in the Township in order to
plan a balanced recreational program for the citizens of the Township
and in order to provide the maximum use of recreational facilities
in the Township.
b. The Township Committee may, by resolution, place public places, playgrounds
and recreational places under the jurisdiction of the Recreation Committee
for scheduling, activities, use, or for such purposes as may be specified
in any such resolution. The Township shall continue to be responsible
for the care, custody, policing, equipping and maintenance of any
such public places, playgrounds and recreational places which may
be placed under the jurisdiction of such Recreation Committee unless
such responsibilities, or any of them, shall be specifically assigned
in any such resolution.
c. The Recreation Committee herein established shall not be, and shall
not be deemed to be, a recreation commission pursuant to N.J.S.A.
40:12-1 et seq., but such Recreation Committee shall have only those
powers and duties as may be set forth herein, or as may be more particularly
provided by resolution of the Township Committee; provided, however,
that in no event shall the Recreation Committee have, or be given,
any powers or duties which would not be permitted to a recreation
commission established under N.J.S.A. 40:12-1 et seq.
d. There shall be no appropriation of public funds made to the Recreation
Committee, or for the use of the Recreation Committee, except that
public funds may be appropriated and used by the Township Committee
for the following purposes connected with such Recreation Committee:
1. For the care, custody, policing, equipping and maintenance of public
places, playgrounds and recreational places as provided in paragraph
b above.
2. The Township shall obtain liability insurance coverage, covering
the approved activities of the Recreation Committee, and protecting
the Township, the Recreation Committee, and the individual members
of the Recreation Committee, in the same manner and to the same extent
as would be done were a recreation commission created pursuant to
N.J.S.A. 40:12-1 et seq.
3. The Township may provide and pay for surety bonds covering the Chairman,
Secretary and Treasurer of the Recreation Committee in the handling
of such funds as the Committee may receive from fees, gifts, donations
or other sources.
e. Neither the Recreation Committee nor any member or members thereof
shall have any power or right, express or implied, to bind or obligate
the Township or the Township Committee, directly or indirectly.

a. The Recreation Committee shall incur no financial obligations and
shall expend no monies, except within the limits of the funds which
may be given or donated to it by private sources, or which may be
received by it as allowable admission fees or allowable charges in
accordance with the provisions of this section. Any and all funds
received by or administered by the Recreation Committee shall be the
funds of the Recreation Committee and shall not be or be considered
funds of the Township Committee.
b. In order to provide the funds, in whole or in part, necessary to
carry out its programs, the Recreation Committee may arrange and provide
for the giving of exhibitions, plays, concerts, games and contests,
and may employ public places, playgrounds, or recreational facilities
for the purpose of giving thereon exhibitions, plays, concerts, games
and contests. The Recreation Committee may charge and collect a reasonable
admission fee for each person entering such public place, playground
or recreation place as a spectator during the time or times when the
same is being used or employed for such purposes, but shall not use
or employ any such public place, playground or recreation place for
such purpose for a greater period than a ratio of one hour to every
two hours in each day during which the public place, playground or
recreation places are utilized nor more than 16 hours in any one calendar
week and when any such public place, playground or recreation place
is used for such purpose, no admission fee shall be charged or collected
from children under 12 years of age. The Recreation Committee may
charge and collect a reasonable service charge from persons using,
as participants, special areas and facilities, which require special
maintenance and the use of which is restricted to relatively few people,
in order to assist in the meeting of the operating costs thereof in
whole or in part. No admission fee or other charge permitted herein,
and no exhibition, play, concert, game or contest, authorized herein,
shall be imposed or undertaken until approved by resolution of the
Township Committee in any case where the use of public lands or facilities
is involved.

The primary purpose of the Recreation Committee shall be to
initiate and to coordinate recreational programs in the Township.
In doing so, the Recreation Committee shall work with the Township
Committee and other boards, agencies and groups, whether or not connected
with the municipal government, in order to provide a balanced recreational
program for the youth in the community. Specific programs shall be
assigned or authorized by the Township Committee, by resolution, in
accordance with the purposes of the Recreation Committee and the provisions
of this section, and subject to the limitations contained herein.

The Recreation Committee may organize as it sees fit, choosing
a Chairman from among its members, and such other officers as it may
deem advisable, adopt rules and by-laws for the proper administration
of its functions, and formulate committees for the administration
and handling of its programs.

In the face of increasing development, the preservation of areas
of open space is vital to the provision of recreational opportunities,
and to the quality of life of present and future generations of Green
Brook Township residents. The Township Committee, therefore, deems
it desirable and necessary that a Committee be formed to aid in the
acquisition of open space, hereinafter defined, in Green Brook Township.
Definition. Open space shall mean land or water areas to be
retained in a largely natural or undeveloped state, for purposes of,
among other things, providing parkland or green spaces, protecting
ecologically sensitive areas, preserving flora and wildlife, or protecting
or preserving areas of scenic, historic and cultural value, while
at the same time affording, wherever practicable, public outdoor recreational
opportunities for the Township's residents.

There is hereby established in the Township the Open Space Committee,
comprised of nine members as follows:
a. One member of the Township Committee to be selected by the Township
Committee;
b. One member of the Planning Board to be selected by the Planning Board;
c. One member of the Zoning Board to be selected by the Zoning Board;
d. One member of the Environmental Commission to be selected by the
Environmental Commission;
e. Five at-large members who are residents of the Township to be selected
by the Township Committee.
f. In addition, there may be not more than two alternate members of
the Open Space Committee, to be appointed by the Mayor for terms of
one year. Alternate members may participate in discussions but may
not vote except in the absence or disqualification of a regular member.
Such Alternate members shall be designated by the Mayor as Alternate
1 and Alternate 2. In the event that a choice must be made as to which
alternate member is to vote, Alternate 1 shall vote. A vote shall
not be delayed in order that a regular member may vote instead of
an alternate member.

The appointments of the representatives of the Township Committee,
Planning Board, Zoning Board and Environmental Commission shall be
for a term of one year, commencing January 1. The initial terms shall
be: one member - one year term; two members - two year terms; two
members - three year terms; all commencing as of January 1, 1998.
After completion of the initial term, the terms for at-large members
shall be staggered three year terms commencing each January 1. Alternate
1 and Alternate 2 shall be appointed for terms of one year commencing
January 1. Vacancies occurring otherwise than by expiration of term
shall be filled by Alternate 1, then Alternate 2 for the unexpired
term only.

The Open Space Committee shall select its Chairperson and Vice-Chairperson
from among its members and shall organize its activities in cooperation
with the Township Committee.

Township Officials and employees shall be available to provide
assistance to the Open Space Committee in the performance of its duties,
as enumerated below.

The duties of the Open Space Committee are as follows:
a. Make recommendations to the governing body on whether lands proposed
for dedication for greenways, stream corridors, mountain preservation,
or general open space preservation shall be accepted or approved by
the Township Committee.
b. Seek, on behalf of the Township, opportunities for the acquisition
of dedicated greenways, stream corridors, mountain preservation, or
general open space, in accordance with priorities established by the
Township Committee on recommendation of the Open Space Committee.
c. Interact with other boards, committees, commissions in the Township
in coordinating recommendations for the acquisition of dedicated greenways,
stream corridors, mountain preservation, or general open space.
d. Assist, as may be needed, in the implementation of dedicated greenways,
stream corridors, mountain preservation, or general open space programs
and other programs established or approved by the Township Committee.
e. Perform such other duties as, from time to time, may be assigned
by the Township Committee.

There is hereby established in the Township of Green Brook a
Cultural, Heritage, and Historic Preservation Committee, which shall
have the duties and powers hereinafter set forth. The members shall
be appointed by the Mayor in accordance with the provisions of this
section.

The objectives of the Cultural, Heritage, and Historic Preservation
Committee shall be as follows:
a. To preserve the history, architecture and cultural heritage of the
Township for future generations.
b. To gather historic documents, photographs, and artifacts; preserve,
and archive records; and, educate residents about the rich history
and cultural heritage of the Township through publications, displays
or other forms of communication.
c. To organize community programs and events that help promote, preserve,
and protect the Township's history and cultural heritage.
d. To encourage participation in these efforts from educational institutions,
community groups, and other interested individuals.

The Cultural, Heritage, and Historic Preservation Committee
shall be composed of seven members, who shall be citizens and either
residents of the Township or individuals who have demonstrated a significant
degree of familiarity with the history and culture of the Township.
The Committee shall be constituted as follows:
a. Except for the initial term periods, as provided for in paragraph
b., six of the appointments shall be for a term of three years. Vacancies
shall be filled for unexpired terms only. Members shall serve until
their respective successors are appointed and qualify and shall receive
no compensation for their services. At least one member of the Cultural,
Heritage, and Historic Preservation Committee shall also be a member
of the Township Committee and shall serve a one-year term. The Cultural,
Heritage, and Historic Preservation Committee shall designate one
of the members of the Committee to serve as Chairman, one to serve
as Vice Chairman, and one to serve as Secretary.
b. The terms of office of the first Committee shall be for one, two,
or three years, to be designated by the Mayor in making each appointment
so that the terms of approximately 1/3 of the members will expire
on December 31 of each year. Succeeding members shall be appointed
for terms of three years, provided, however, members shall serve until
the appointment and qualification of their successors.
c. The Township Committee may remove any member of the Cultural, Heritage,
and Historic Preservation Committee for cause on written charges served
upon the member and after a hearing thereon at which the member shall
be entitled to be heard in person or by counsel.
d. A vacancy occurring other than by expiration of a term shall be filled
by resolution of the Township Committee for the unexpired term consistent
with the original appointment. Members so appointed to the Committee
may be a member of other municipal boards or agencies.
e. The Cultural, Heritage, and Historic Preservation Committee shall
have up to four alternate members to be appointed to the Cultural,
Heritage, and Historic Preservation Committee by resolution of the
Township Committee. Any such appointment shall be for a term of one
year, and the alternate(s) so appointed shall have the same duties
as are designated for regular members herein.
f. Any meeting convened by the Cultural, Heritage, and Historic Preservation
Committee to transact business shall require a quorum of four members
who may be regular or alternate members or any combination thereof.
g. No Committee member shall be permitted to act on any matter in which
he or she has, either directly or indirectly, any personal or financial
interest.

The primary purpose of the Cultural, Heritage, and Historic Preservation Committee shall be as set forth in subsection
2-39.5 of this section. In doing so, the Cultural, Heritage, and Historic Preservation Committee shall work with the Township Committee and other boards, agencies and groups, whether or not connected with the municipal government, in order to provide a historical resource for the community.
The Cultural, Heritage, and Historic Preservation Committee
shall:
a. Undertake research, review historical surveys, and evaluate historical
documents in order to identify historically or culturally significant,
public and private sites, including both areas and structures, within
the Township.
b. Maintain a Green Brook Township historical resource document that
designates historically or culturally significant sites. The documents
shall include detailed information about each site justifying the
reason for the designation. The document shall be reviewed annually
and updated as required.
c. Provide guidance to the Green Brook Planning Board during the preparation
of any historic preservation plan elements of the Master Plan.
d. Provide guidance to Green Brook Township Planning and Zoning Boards
in determining the likely impact of proposed projects on historically
or culturally significant sites, as well as suggest ways to minimize
any potential impact.
e. Provide guidance to the Township Committee on the relative merits
of Township projects involving publicly owned, historically or culturally
significant sites.
f. Assist the Township Committee in securing State, Federal, and other
grants for historic preservation and cultural projects.
g. Secure voluntary assistance from individuals and organizations in
support of the Township's historic preservation and cultural
projects.
h. Work with local, County, State, and national historic societies and
government entities to maximize the Township's historic preservation
and cultural efforts.
i. Act as a resource for property owners and other persons and groups
interested in the historic preservation and cultural history of Green
Brook.
j. Undertake educational programs, which may include the: (1) preparation
of publications aimed at stimulating interest in the Township's
history, (2) organization of events to enhance public awareness of
Township history, and (3) placing of and maintenance of historic markers
identifying the Township's historically or culturally significant
sites.
k. Undertake such other efforts, at the direction of the Township Committee,
to acquire, manage, and preserve documents, artifacts or other property
that fall within the mandate to the Cultural, Heritage, and Historic
Preservation Committee.
l. Act as a resource for property owners and other persons and groups
interested in the historic preservation and cultural history of Green
Brook Township.

The Cultural, Heritage, and Historic Preservation Committee
herein established shall not be, nor shall it be deemed to be, a Historic
Preservation Commission pursuant to N.J.S.A. 40:55D-107 et seq., but
such Cultural, Heritage, and Historic Preservation Committee shall
have only those powers and duties as may be set forth herein, or as
may be more particularly provided by resolution of the Township Committee;
provided, however, that in no event shall the Cultural, Heritage,
and Historic Preservation Committee have, or be given, any powers
or duties not otherwise established by this section.

a. The Township Committee is hereby authorized to appropriate public
funding as it deems appropriate for the benefit of or use by the Cultural,
Heritage, and Historic Preservation Committee for the following purposes:
1. To enable the Township to obtain liability insurance coverage, covering
the approved activities of the Cultural, Heritage, and Historic Preservation
Committee, and protecting the Township, the Cultural, Heritage, and
Historic Preservation Committee and its individual members.
2. To provide and pay for surety bonds covering the Cultural, Heritage,
and Historic Preservation Committee and/or its members in the handling
of funds which it may receive from any source whatsoever.
3. To provide for annual budgetary requirements of the Cultural, Heritage
and Historic Preservation Committee as it may deem appropriate.
b. Neither the Cultural, Heritage, and Historic Preservation Committee
nor any member thereof shall have the power or the right, expressed
or implied, to bind or obligate the Township or the Township Committee,
directly or indirectly, for any financial undertaking.

The Cultural, Heritage and Historic Preservation Committee may
secure additional funding by arranging events and collecting admission
fees or other reasonable charges and by soliciting and receiving donations
from private sources. No exhibition or other fund raising activity
shall be undertaken and no admission fee or other charge shall be
collected until approved by resolution of the Township Committee.

There is hereby established in the Township of Green Brook a
Green Design Group, which shall have the duties and powers hereinafter
set forth. The members shall be appointed by the Mayor in accordance
with the provisions of this section.

The objectives of the Green Design Group shall be as follows:
a. To investigate "green" initiatives for climate protection, energy
and resources conservation available to the municipality.
b. To educate the businesses and residents of the Township through publications,
displays or other forms of communication on opportunities to use all
resources wisely.
c. To organize community programs and events that help promote, preserve,
and protect the climate, environment and natural resources, and to
conserve energy.
d. To encourage participation in these efforts from educational institutions,
community groups, and other interested individuals.

The Green Design Group shall consist of five members, either
residents or entrepreneurs of the Township or individuals who have
demonstrated a significant degree of familiarity with the concepts
of environmental protection and conservation of energy and other natural
resources of the Township. The Green Design Group shall be constituted
as follows:
a. Except for the initial term periods, as provided for in paragraph
b., three of the appointments shall be for a term of three years.
Vacancies shall be filled for unexpired terms only. Members shall
serve until their respective successors are appointed and qualify
and shall receive no compensation for their services. At least one
member of the Green Design Group shall also be a member of the Township
Committee and shall serve a one-year term. The Green Design Group
shall designate one of the members of the Group to serve as Chairman,
one to serve as Vice Chairman, and one to serve as Secretary.
b. The terms of office of the first Group shall be for one, two, or
three years, to be designated by the Mayor in making each appointment
so that the terms of approximately 1/3 of the members will expire
on December 31 of each year. Succeeding members shall be appointed
for terms of three years, provided, however, members shall serve until
the appointment and qualification of their successors.
c. The Township Committee may remove any member of the Green Design
Group for cause on written charges served upon the member and after
a hearing thereon at which the member shall be entitled to be heard
in person or by counsel.
d. A vacancy occurring other than by expiration of a term shall be filled
by resolution of the Township Committee for the unexpired term consistent
with the original appointment. Members so appointed to the Green Design
Group may be a member of other municipal boards or agencies.
e. The Green Design Group shall have up to four alternate members to
be appointed to the Green Design Group by resolution of the Township
Committee. Any such appointment shall be for a term of one year, and
the alternate(s) so appointed shall have the same duties as are designated
for regular members herein.
f. Any meeting convened by the Green Design Group to transact business
shall require a quorum of four members who may be regular or alternate
members or any combination thereof.
g. No Group member shall be permitted to act on any matter in which
he or she has, either directly or indirectly, any personal or financial
interest.

The primary purpose of the Green Design Group shall be as set
forth in subsection 2-39A.2 of this section. In doing so, the Green
Design Group shall work with the Township Committee and other boards,
agencies and groups, whether or not connected with the municipal government,
in order to provide a resource for the community.
The Green Design Group shall:
a. Undertake research and review industrial and scientific data, and
evaluate energy and resources conservation programs and policies in
order to identify cost and resource saving opportunities for the Township.
b. Provide guidance to the Green Brook Township Committee in formulating
"green" policies for the Township.
c. Assist the Township Committee in securing state, federal, and other
grants for energy saving and resource conservation and recycling projects.
d. Secure voluntary assistance from individuals and organizations in
support of the Township's "green" initiatives.
e. Work with local, County, State, and national government entities
and nonprofit groups to maximize the Township's efforts toward
"green" policies and energy conservation.
f. Act as a resource for property owners and other persons and groups
interested in "green" technology and energy conservation.
g. Undertake educational programs, which may include the: (1) preparation
of publications aimed at stimulating interest in the conservation
of energy and natural resources, events to enhance public awareness
of "green" initiatives.
h. Undertake such other efforts, at the direction of the Township Committee,
to promulgate "green" initiatives and energy conservation within the
Township.
i. Act as a resource for property owners and other persons and groups
interested in "green" initiatives and energy and resources conservation.

The Green Design Group herein established shall have only those
powers and duties as may be set forth herein, or as may be more particularly
provided by resolution of the Township Committee; provided, however,
that in no event shall the Green Design Group have, or be given, any

There is established in and for the Township, the Green Brook
Youth Services Commission and the By-Laws of the Green Brook Youth
Services Commission.

a. The Township Committee may appropriate funds for the expenses of
the Commission, or programs recommended by the Commission as beneficial
to the community.
b. The Township Committee may assign a staff person to assist the membership
as the Commission may require, within the limits of funds appropriated
to it.
c. Notwithstanding any powers herein granted to the Youth Services Commission,
it shall not obligate itself or attempt to obligate the Township beyond
the limits of any appropriation made to it, or other funds which may
be donated to it, awarded in form of grants in aid, or made otherwise
available to such Commission.
