Maintenance, repair, replacement, restoration, rebuilding or remodeling
may be allowed if the activity does not expand the footprint, or change
the use or purpose unless it complies with ordinance provisions, of
the nonconforming structure including, but not limited to, detached
garages, sheds, barns, gazebos, patios, decks, swimming pools, hot
tubs, fences, retaining walls, driveways, parking lots, sidewalks,
detached stairways and lifts. An existing structure that was lawfully
placed when constructed, but does not comply with the required setback,
may be vertically expanded unless the vertical expansion would extend
more than 35 feet above grade level. Expansion beyond the footprint
may be allowed to comply with applicable state or federal requirements.
