As used in this article:
PUBLIC RIGHT-OF-WAY
Any area dedicated for public use as a public street, pedestrian
way or other thoroughfare, including but not limited to, roadways,
parkways, alleys, sidewalks and pedestrian ways.
RAMPING
An area of right-of-way or parking facility where vehicles
are permitted to be stopped in order to transfer the vehicle from
a customer to a Valet Parking Attendant for the purpose of parking
the vehicle at another location.
VALET PARKING
Any person, firm or corporation engaged in, conducting or
managing the receiving, taking possession of, driving, moving, parking,
or leaving standing other persons' motor vehicles, whether or not
a charge is levied, and whether or not such persons are employed by,
or under contract to the business for which the vehicles are being
parked.
VALET PARKING ATTENDANT
Any employee or agent of the Valet Parking Operator, who
receives, takes possession of or moves any vehicle, or who handles
the keys to any vehicle left with the attendant for Valet Parking.

No person, establishment or entity shall conduct or engage in
any valet parking operation upon any portion of the public right-of-way
or utilize a City-owned public parking facility, except under the
terms and conditions under the operator's valet parking license. Using
the public street or right-of-way for drop-off and pick-up of vehicles
in any manner must be done under the terms and conditions of the valet
parking license.

Valet parking service shall be operated only by the City of
Asbury Park or additional commercially licensed and insured vendors
of parking services holding valid city valet parking licenses.

a. The annual license fee for establishing or maintaining a valet parking
service shall be $300, with an application fee of $100.
b. Exceptions. The annual license fee may be waived for any valet parking
service operator which is contracted directly by the City of Asbury
Park.

Permits shall be issued only to permittees/operators that provide
certification, in a format approved by the City Clerk and City Attorney,
that they have procured sufficient accessible off-street parking spaces
for their valet parking services. On-street parking spaces shall not
be included in the computation of sufficient parking spaces for valet
parking. Agreements with owners of private parking lots for use by
the valet parking service shall be provided to the City prior to issuance
of a license.

a. Prior to the issuance of a permit, the permittee/valet operator shall
furnish the City Clerk with a signed statement, approved by the City
Attorney, that the permittee/operator shall hold harmless, indemnify
and defend the City of Asbury Park, its officers and employees, for
any claims for damages to property or injury to persons which may
be occasioned by any activity carried on under the terms of the permit.
b. Permittee shall furnish and maintain such public liability and property
damage insurance a minimum of $2,000,000 to protect all from claims
and damage to property or bodily injury, including death, which may
arise from operations under the permit or in connection therewith.
c. The permittee/operator shall provide proof of all required insurance
prior to receiving the permit.

a. The permittee/operator shall maintain a key control booth at all
valet parking locations until all cars have been claimed; or the permittee/operator
shall have a 24-hour phone number for after-hours vehicle pick up
information.
b. All employees who operate motor vehicles shall have in their possession
a valid State-issued driver's license in good standing and shall abide
by all state New Jersey traffic regulations.
c. All employees who shall operate motor vehicles shall do so in a safe
and responsible manner.
d. All employees shall be in uniforms identifying their names and the
name of the valet operator/company.
e. All employees should perform their duties in a courteous and professional
manner.
f. Valet Operators shall supply sufficient resources to process the
volume of vehicles generated without impeding the safe flow of traffic.
Ramping from a moving lane of traffic is strictly prohibited. Vehicles
shall not be stored in ramping areas. Ramping of vehicles shall consist
of allowing customers to enter or exit a vehicle and to turn it over
to or retrieve it from valet employees. Ramping on public property
shall not occur in any location other than the on-street/curbside
spaces provided for ramping.
g. Storage of vehicles shall only be in private off-street parking spaces
or in leased municipal spaces as provided the by the City of Asbury
Park. Valet operators shall clearly identify the vehicles in their
possession during the entire period that the vehicle is in their possession.

Valet Services operating for a special event may apply for a
special event permit through the City's Office of Special Events.
Special event parking shall be restricted to any event occurring no
more than four times per year and lasting no longer than 8 hours in
length. The special event permit will allow the valet operator to
request from the City additional ramping and/or storage space, if
available.

a. It shall be unlawful for a valet operator to provide or engage in
valet parking service without a valid parking license issued pursuant
to this article. A valet parking permit that has expired or has been
suspended or revoked is not a valid permit.
b. It shall be unlawful for a valet operator to provide or engage in
valet parking service in violation of the terms and conditions of
a valet parking permit that pertains to the valet parking service.
c. It shall be unlawful for a valet operator to stop or direct traffic.

Any person who violates Subsection
8-37.8 shall be subject to a civil penalty of $100 for each violation and $50 for each day the violation occurs.

a. Rental and Operation of Municipal Spaces. The City of Asbury Park
shall rent to the valet operator public on-street/curbside spaces
that shall only be used for ramping of vehicles. In no event shall
long-term storage take place in the ramp space rented. Vehicles shall
not be stored in ramp area. A vehicle will be considered stored if
it remains in the ramp area for more than fifteen (15) minutes. Ramping
of vehicles shall consist of allowing customers to enter or exit a
vehicle and to turn it over to or retrieve it from valet employees.
Ramping shall only be operated in the public on-street/curbside spaces
provided by the City of Asbury Park for ramping.
b. Ramping on public property shall not occur in any location other
than the on-street/curbside spaces provided for ramping. Leased spaces
shall not be blocked by any type of sign, structure, or other type
of object. Leased spaces shall not be cordoned off by any type of
signage, rope or barrier of any kind, except for signage approved
by the City of Asbury Park. At its sole discretion and judgment, the
City of Asbury Park shall provide to the valet operator sufficient
ramping space in a close proximity to the establishment being serviced,
if sufficient spaces are available. If there is not sufficient space
available for rental in front of the establishment, the City of Asbury
Park shall lease spaces as close to the establishment as possible.
Notwithstanding the above, ramping will not be allowed if the City
of Asbury Park determines, at its sole discretion, that is would be
an unsafe activity at that location.
c. Rental Fees For Public On-Street/Curbside Spaces. The fees for use
of rented spaces shall be $15 per space/per day, seven days per week
for up to 12 hours per day. Fees assessed for 24-hour-per-day use
shall be $30 per day per space. Fees shall be paid bi-weekly, two
weeks in advance, commencing on the date the locations are rented
to the valet operator by the City of Asbury Park. All additions or
changes to existing leased public on-street/curbside parking spaces
for ramping shall be paid upon request. All valet space lease requests
shall be required in writing to the City of Asbury Park a minimum
of 24 hours in advance and received no later than 2:00 p.m. daily.
Exceptions and lease cancellations not made within the prescribed
period will be assessed a $25 processing fee. Ramping fees may be
waived or negotiated for any valet parking service operator which
is contracted directly by the City of Asbury Park.
d. Number of Spaces Leased For Ramping. The amount of ramping spaces
available to the valet operator shall be determined by the frontage
of the establishment being serviced provided there is sufficient public
on-street/curbside spaces available for ramping, as determined in
the sole discretion of the City of Asbury Park.
e. Subletting. Leased public on-street/curbside or off-street spaces
may not be sublet to another valet parking operator under any circumstance.

The City shall cancel and revoke the permit if the valet operator
no longer services the commercial establishment, which authorized
its operation at that location. This cancellation and revocation may
be effective whether the valet operator voluntarily discontinues the
service to the establishment, the establishment cancels or revokes
authorization for the valet parking operator to service the location,
or the City of Asbury Park cancels and revokes authorization for the
valet operator to service the location.
