An EDU shall be 280 gallons of sewage flow per day.

Each residential unit shall pay a quarterly service charge of $123 per quarter with the service charge being paid in advance at the beginning of each quarter.

Each commercial unit shall pay a quarterly service charge of $123 per quarter per EDU in accordance with the number of EDUs assessed to that commercial unit. The beginning or initial EDUs for each project customer is set forth in the connection or tap-in ordinance, Ord. No. 103A,[1] which will be enacted immediately prior hereto. The service charge shall be paid in advance at the beginning of each quarter.

The EDUs for each commercial unit for service charge fees shall be determined by the Township Engineer in accordance with the Department of Environmental Protection's Domestic Wastewater Facilities Manual.

The beginning dates of the yearly quarters for service charges shall be January 1, April 1, July 1 and October 1 of each year.

The number of gallons of sewage generated per day shall be estimated and determined exclusively by Township based upon either the regulations of the Department of Environmental Protection or upon measured sewage flows.

The above quarterly sewer charges shall be for sewage collection and amortization of the debt for the establishment and creation of the Sybertsville sewer system. Sewage treatment fees to the Conyngham Borough Authority or its successor are included in their quarterly service charges.

The first bill for quarterly sewer service charges from Township will issue on October 1, 2000, and if earlier or later the bill will be prorated for the quarter in which the bill is issued.

In the event that charges for sewer service are not paid within 30 days after rendition of the bill for such service, such charges shall be deemed and are hereby declared to be delinquent, and thereafter, such delinquency shall constitute a lien upon the real estate for which such service is supplied. If a sewer service bill is not paid within 30 days, there will be a late or delinquent charges added to said in the amount of 10% of the bill. The Township will take whatever legal steps are necessary and proper to collect such delinquent bills. Any costs or charges incurred in the collection of a delinquent bill, including Magisterial District Judge and court filing fees and attorneys' fees, shall be imposed upon and paid by the delinquent property owner or project customer.

The real property owners or project customers shall be responsible for the payment of the quarterly service charges and this responsibility for payment and duty to pay cannot be transferred from said property owner or project customer to any tenant or lessee of said property owner or project customer.

Any person, firm or corporation who shall violate any provision of this Subpart 5C, upon conviction thereof in an action brought before a Magisterial District Judge in the manner provided for the enforcement of summary offenses under the Pennsylvania Rules of Criminal Procedure, shall be sentenced to pay a fine of not more than $1,000, plus costs, and, in default of payment of said fine and costs, to a term of imprisonment not to exceed 90 days. Each day that a violation of this subpart continues or each section of this subpart which shall be found to have been violated shall constitute a separate offense.
