This chapter shall apply to all new fences and enlargement of existing fences.
For the purpose of this chapter, certain terms are herewith defined as follows:
FENCE
Any partition, structure, or gate erected as a dividing marker, barrier or enclosure, including hedges or living bushes or shrubs, within or along the bounds of a lot parcel.
HEIGHT
The distance from the grade (ground) to the top of the highest point of the fence at any given point along the fence.
Fences must be at least 18 inches away from the property line to allow for maintenance of the fence.
Prior to erection, installation, or enlargement of any fence, an application for a building permit must be submitted and approved. A building permit shall be applied for at the Village of Mishicot Hall. All fences shall be maintained in good repair and in structurally sound condition. The fence must be constructed within one year from the date of issuance of the permit or the permit will expire.
A. 
For all fences the installing or requesting party shall construct the fence with the post side or "bad side" facing the installing party's property and the decorative or finished side facing the adjacent or abutting property or street. This provision shall apply to side yard, rear yard, and front yard fences.
B. 
Fence regulation shall be divided up with the zoning district.

(1) 
Residential areas (R-1, R-2 and R-3).
(a) 
A fence shall not contain electrification, barbed wire, razor wire, spikes, nails, or any other sharp, pointed instruments affixed, placed upon or allowed to exist in any manner attached to the fence or part of a fence.
(b) 
No person shall install, construct, or maintain any fence on an easement or right-of-way if the fence would significantly interfere with the easement or right-of-way.
(c) 
Materials shall consist of cyclone-type material links and post, wood components or equivalent materials, or natural vegetation.
(d) 
Fences on all lots of record in all residential districts which enclose property or within a required side and rear yard shall not exceed six feet in height, measured from the surface of the ground. The ground may not be artificially raised for the purpose of increasing the fence height.
(e) 
Fences must be one foot away from any sidewalk. At an intersection, the fence must be erected 25 feet away from the corner right-of-way.
(f) 
Fences up to four feet in height may be erected from the front edge of the dwelling to within 15 feet of the right-of-way unless the fence is of chain-link, split rail, or other see-through material, which can then be erected from the front edge of the dwelling to and along the road right-of-way.
(g) 
Consideration shall be given as to whether a proposed fence enhances the neighborhood or blocks scenic views for nearby property owners and is aesthetically pleasing and in keeping with the character of the neighborhood.
(h) 
All fences shall be maintained in good condition, including but not limited to paint, stain, and repair of damaged portions, rusted metal, holes, loose components, and sagging fence portions.
(i) 
Abandoned and/or unmaintained fences shall be repaired or removed within 14 days of written notice given by the Mishicot Village Board of Trustees.
(2) 
Commercial, industrial, and business districts ( B-1, I-1 and I-2). Fencing proposals shall be included in any plans submitted for site plan review and will be approved or denied by the Mishicot Village Board of Trustees.
A. 
Swimming pools. All swimming pools with a water depth of two feet or greater at any point shall be enclosed with a six-foot-high fence not closer than four feet to the pool's edge on any side. Gates in the fence shall have a self-latching catch or lock located not closer to the grade than four feet and otherwise made inaccessible from the outside to small children.
A. 
Temporary fences made of woven wire material placed around flower and/or vegetable gardens that do not exceed four feet in height will not require a building permit.
B. 
Wood or plastic snow fences for the purpose of limiting snow drifting between November 1 and April 1, protecting construction and excavation sites, and protecting plants during grading and construction are permitted up to 120 days consecutive days or for intervals not exceeding an aggregate of 120 days in any calendar year.

Violation of this chapter shall be subject to a penalty as provided in § 1-2 of this Code.
