The following words, terms and phrases, when used in this article, shall have the meanings ascribed to them in this section, except where the context clearly indicates a different meaning:
COMMISSIONER
The Commissioner of Codes Enforcement.
ELECTRICAL INSPECTOR
The duly appointed Electrical Inspector of the City of Utica. The Codes Commissioner shall appoint the Electrical Inspector. The Electrical Inspector reports to and is accountable to the Commissioner of Codes Enforcement.
ELECTRICAL INSTALLATIONS
All electrical wiring, systems, devices, equipment and appliances for the distribution or use of electrical energy.
ELECTRICAL WORK
Any installation of electrical conductors; fittings; devices; raceways; fixtures; motors; generators; starters; controllers; control wiring and related equipment, including heating and air conditioning, wiring, controls, motors, and related electrical equipment for heating and air-conditioning units; wiring of fire protection equipment; that part of elevator installations consisting of feeder conductors and raceways to motor and generator disconnect switches and controllers, including wiring to elevator equipment; service, supply equipment and receptacles for trailer connections; and all electrical equipment used for power supply to radio and television transmitting equipment, including any and all equipment as covered by the National Electrical Code, NFPA 70, as adopted.
ELECTRICIAN
The holder of a valid license, as described herein.
EMERGENCY REPAIR
Any repair which is commenced and necessitated by an equipment failure or impairment which occurs at a time frame when the Codes Department is not open for the issuance for permits.
OPENING
For the purpose of calculating the permit fee, shall include but shall not be limited to each: receptacle, fixture, switch, furnace, water heater, baseboard heater, dryer, service drop, transformer, main disconnecting/overcurrent device, feeder overcurrent device, meter, fire pump/controller, fire alarm initiating device, fire alarm indicating device, fire alarm supervisory device, fire alarm control/aux item, burglar alarm initiating device, motor, and emergency lights/remote heads.
THIRD-PARTY ELECTRICAL INSPECTOR
The City of Utica may require the services of a third-party electrical inspector to perform the duties of the Electrical Inspector if the Electrical Inspector is unable to. The third-party electrical inspector shall be a Utica licensed master electrician or other person whose experience, certifications, and trainings has been demonstrated to the satisfaction of the Electrical Inspector. Such third-party inspector shall certify the results of his inspection to the City of Utica.
(a) 
This article applies to the administration and enforcement of the National Electrical Code, NFPA 70, as adopted by the National Fire Protection Association. The publication of the National Electrical Code as adopted by New York State, as hereinafter and from time to time amended, is hereby adopted and made part of the Electrical Code of the City of Utica.
(b) 
The provisions of this article apply to electrical equipment within or on public or private buildings or premises. The provisions of this article do not apply to the following:
(1) 
Special radio and television equipment used exclusively for transmission by persons or organizations licensed to operate by the Federal Communications Commission.
(2) 
Installations in mines, ships, railway cars or automotive equipment.
(3) 
Installation used by an electricity supply agency in the generation, alteration or repair of electrical equipment which is under the sole jurisdiction of an electricity supply agency for the use of the agency in the generation, transmission, distribution or metering of electricity or to the agency's employees making the installation for the agency.
(4) 
Installations used by a communications agency for the operation of signals or the transmission of intelligence or for the installation, alteration or repair of electrical equipment for the operation of signals or the transmission of intelligence or to the agency's employees making the installations for the agency.
(5) 
Installations and equipment used by a railway utility in the exercise of its functions as a utility and used exclusively for that purpose such as train-signaling devices, track-operating devices and communication equipment, or to its employees making the installations for the railway utility.
(6) 
Replacement of lamps or the connection of portable electrical equipment to suitable and approved permanently installed receptacle outlets.
(7) 
Temporary connections used by manufacturers for testing electrical equipment or apparatus, except that this exemption shall not include any permanent wiring.
This article shall not be construed to relieve or lessen the responsibility or liability of any person owning, operating, controlling, installing, altering or repairing any electrical systems or equipment for damages to persons or property caused by any defect therein, nor does the City of Utica assume any such liability or responsibility therefor by reason of inspections authorized herein or permits or licenses issued as herein provided.
