Any act declared to be unlawful under any section of any chapter of this Code shall be a misdemeanor and shall be punished as set forth in §
1-1 of the City Code. Likewise, the failure to do any act or thing required by any section of this Code is declared a misdemeanor and shall be punished as set forth in §
1-1 of the City Code.
It shall be unlawful for any person, firm or corporation to
maintain, keep, work in, gather at, visit or patronize any bawdy house
or place of business of ill fame, prostitution or where any person
or persons can or may visit or gather for immoral, carnal or sexual
intercourse within the limits of the City of Walhalla.
It shall be unlawful for any person to counsel, advise, incite,
abet, procure or aid any other person in the violation of any of the
ordinances of the City of Walhalla. Such person shall be held and
deemed an accessory.
A. It shall be unlawful for anyone to carry about the person, whether
concealed or not, any pistol less than 20 inches long and three pounds
in weight or for any person to manufacture, sell, offer for sale,
lease, rent, barter, exchange or transport for sale into this state
any pistol of less length and weight. Any violation of this section
shall be punished by a fine of not more than $100 or imprisonment
for not more than 30 days; and in case of a sale, the sum of $100
shall be forfeited to and for the use of the school fund of the county
wherein the violation takes place, to be recovered as other fines
and forfeitures; provided this section shall not apply to peace officers
in the actual discharge of their duties or to the carrying or keeping
of pistols by persons while on their own premises nor abridge the
right of self-defense.
B. In case it shall appear to the satisfaction of the presiding judge
or magistrate before whom such offense is tried that the defendant
had good reason to fear injury to his person or property and carried
the weapon to protect himself or property he may, in his discretion,
suspend sentence.
C. Carrying concealed weapons a misdemeanor; forfeiture of weapons.
Any person carrying a pistol, dirk, slingshot, metal knuckles, razor
or other deadly weapons usually used for the infliction of personal
injury concealed about his person shall be guilty of a misdemeanor
and, upon conviction thereof before a court of competent jurisdiction,
shall forfeit to the county, or if convicted in a municipal court,
to the municipality, the weapon so carried concealed and be fined
in the sum of not more than $100 and not less than $20 or be imprisoned
not more than 30 days nor less than 10 days, in the discretion of
the court. Nothing herein contained shall be construed to apply to
persons carrying concealed weapons upon their own premises or to peace
officers in the actual discharge of their duties as such.
It shall be unlawful for any person to damage or interfere with,
in any way, any publicly or privately owned property within the limits
of the City of Walhalla.
It shall be unlawful for any person or persons to tack signs
upon, drive nails in, cut, carve upon or in anywise mutilate, damage
or interfere with any pole supporting electric, telephone or telegraph
wires in the City of Walhalla.
It shall be unlawful for any person to engage in any malicious
mischief or boisterous, tumultuous, disorderly, indecent, immoral
or riotous conduct of any kind, or do any act or thing which tends
to create any disturbance within the limits of the City of Walhalla,
or which might disturb the peace, good order, quiet or tranquility
of said City.
It shall be unlawful for any person to engage in, aid, abet,
counsel or encourage in any fight, quarrel, fracas or affray within
the limits of the City of Walhalla.
It shall be unlawful for any person or persons to keep, set
up or use any gambling or gaming table or other instrument for the
purpose of gambling or gaming and/or to engage in any game of cards,
dice or other like game for money or other valuable consideration
within the corporate limits of the City of Walhalla.

It shall be unlawful for any person to shoot, fire or discharge
any gun, pistol or other firearms at any time and anywhere within
the limits of the City of Walhalla; provided, however, that if it
is shown to the satisfaction of the Municipal Court Judge that such
shooting, firing or discharging of said firearms was justified or
necessary, the Municipal Court Judge may suspend, in his discretion,
any sentence imposed.

It shall be unlawful for any person to willfully expose his
person or engage in any other indecent conduct upon the streets or
in any public place within the limits of the City of Walhalla. This
section does not apply to a woman who breastfeeds her own child in
a public place, on property of others, to the view of any person on
a street or highway or any other place where a woman and her child
are authorized to be.
It shall be unlawful for any person or persons to steal, take
and carry away any goods, chattels, livestock, furniture, fixtures
or other personal property of another within the limits of the City
of Walhalla.
It shall be unlawful for any person to use vulgar, indecent,
obscene, profane, blasphemous, offensive, abusive or quarrelsome language
or words in or upon the streets or other public places within the
City of Walhalla or at any place in said City where the same may be
heard by the public.
Any person who shall, within the City, buy or receive any goods
or chattels which have been feloniously taken or stolen from some
other person, knowing the goods or chattels to have been stolen, shall
be deemed guilty of a misdemeanor.
It shall be unlawful for any person, firm or corporation to
solicit funds within the corporate limits of the City of Walhalla
for any purpose whatsoever without first obtaining consent from the
City Council in meeting duly assembled, provided that the provisions
of this section shall not apply to citizens of the City of Walhalla
who are soliciting funds for local use.

It shall be unlawful for any person to purchase, buy, fire,
explode, light, sell or use within the limits of the City of Walhalla
any fireworks, including torpedoes, Roman candles, fire rockets, fire
crackers, sky rockets and any and all other forms of fireworks which
contain powder, except as specifically approved by the City of Walhalla
for special events and which meet Fire Code conditions.
It shall be unlawful for any person or persons to unlawfully
assemble on any street, sidewalk, roadway or other thoroughfare within
the City of Walhalla in a manner which shall interfere with the lawful
use of such passageways or to hinder the movement of traffic or persons
or vehicles in any manner whatsoever.
It shall be unlawful for any person, firm or corporation to
distribute, place or leave any handbills, circulars or other form
of advertising in or on any motor vehicle parked on the streets of
the City of Walhalla or within any public parking area or industrial
parking area within the corporate limits of the City of Walhalla.
It shall be unlawful for any person to manufacture, keep, store,
receive, have in possession, carry, transport, ship in any vehicle,
vessel, aircraft or other chattel, or to buy, sell, exchange, barter
or deliver any alcoholic liquors unlawfully acquired or which do not
bear proper federal and state revenue stamps, or to accept, receive
or have in possession for unlawful use.
It shall be unlawful for any person to drink alcoholic liquors
on the premises of any retail or wholesale alcoholic liquor business
or business establishment.
Any alcoholic liquors found in the possession of anyone within
the City of Walhalla not having affixed to the bottle or container
the state revenue stamps are hereby declared to be contraband, and
the same may be seized without warrant and shall be destroyed by the
proper officers.
If any alcoholic liquor in any quantity is sold from any vehicle,
vessel or other chattel, or if any alcoholic liquor is possessed,
carried, shipped, stored in, kept on or transported in such vehicle,
vessel or other chattel in violation of law, such alcoholic liquor
and vehicle, vessel or other chattel shall be seized and disposed
of according to law.
It shall be unlawful for anyone to sell from any vehicle, vessel
or other chattel any quantity of alcoholic liquors, stamped or unstamped.
It shall be unlawful for anyone to appear or to be on the streets
of the City of Walhalla or in any public place in the City of Walhalla
while under the influence of intoxicating beverage or drugs or while
conducting himself in a disorderly manner.
It shall be unlawful for any person to purchase or otherwise
procure any alcoholic liquor within the City of Walhalla other than
that purchased from licensed dealers within said City of Walhalla.
