Any motorized vehicle manufactured and used exclusively for off-highway use which is more than fifty (50) inches but no more than eighty (80) inches in width, measured from outside of tire rim to outside of tire rim, with an unladen dry weight of three thousand five hundred (3,500) pounds or less, traveling on four (4) or six (6) wheels, to be used primarily for landscaping, lawn care, or maintenance purposes.

A. 
No person shall operate a utility vehicle, as defined in Section 301.010, RSMo., upon the alleyways, streets or highways of the City of Rogersville, except as follows.
1. 
Utility vehicles owned and operated by a governmental entity for official use.
2. 
Utility vehicles operated for agricultural purposes or industrial on-premises purposes between the official sunrise and sunset on the day of operation.
3. 
Utility vehicles whose operators carry the special permit pursuant to Section 304.032(4), RSMo., which permit shall cost fifteen dollars ($15.00). Said permit shall be displayed on the rear of the vehicle in a visible manner. First permits obtained in 2020 pursuant to this Chapter shall be effective through December 31, 2021, and shall expire at 12:01 a.m. on January 1, 2022. Thereafter, said permits must be renewed annually.
4. 
Utility vehicles must have a yearly inspection of all safety features and equipment required to operate within the City of Rogersville by a designated City inspector at the cost of ten dollars ($10.00) before a permit will be issued.
5. 
Any person operating a utility vehicle pursuant to a municipal resolution or ordinance shall maintain proof of financial responsibility in accordance with Section 303.160, RSMo., or maintain any other insurance policy providing equivalent liability coverage for a utility vehicle.

No person shall operate an off-road vehicle, as defined in Section 304.001, RSMo., within any stream or river in this City, except that off-road vehicle may be operated within waterways which flow within the boundaries of land which the operator owns, or for agricultural purposes within the boundaries of land which the operator owns or has permission to be upon, or for the purpose of fording such stream or river of this State at such road crossing as are customary or part of the highway system. All Law Enforcement Officials or Peace Officers of this State and its political subdivision shall enforce the provisions of this Section within the geographical area of their jurisdiction.

A person operation a utility vehicle on a street or highway pursuant to an exception covered in this Chapter shall have a valid operator's license or chauffeur's license, shall be at least eighteen (18) years of age; and, shall provide to City Clerk proof of liability insurance as required for the operation of a vehicle, as it pertains to the all-terrain vehicle they are obtaining a permit to operate; but, shall not be required to have passed an examination for the operation of a motorcycle and the vehicle shall be operated at speeds of less than thirty (30) miles per hour. When operated on a street or highway, an all-terrain vehicle shall have a bicycle safety flag, which extends not less than seven (7) feet above the ground attached to the rear of the vehicle. The bicycle safety flag shall be triangular in shape with an area of not less than thirty (30) square inches and shall be dayglow in color.

A. 
No person shall operate a utility vehicle:
1. 
In any careless way as to endanger the person or property of another.
2. 
While under the influence of alcohol or any controlled substance.
3. 
Without a securely fastened safety helmet on the head of an individual who operates an all-terrain vehicle or who is being towed or otherwise propelled by an all-terrain vehicle, unless the individual is at least eighteen (18) years of age.
4. 
While carrying a passenger, except for agricultural purposes.

A violation of this Chapter shall be considered a misdemeanor.

A. 
Every utility vehicle, except those used in competitive events, shall have the following equipment:
1. 
Lighted headlamps and tail lamps which shall be in operation at any time in which an utility vehicle is being used on any street or highway in this City/State pursuant to Section 304.014, RSMo.
2. 
An equilateral triangular emblem, to be mounted on the rear of such vehicle at least two (2) feet above the roadway when such vehicle is operated upon any alleyway, street, or highway. The emblem shall be constructed of substantial material with a fluorescent yellow/orange finish and a reflective red border at least one (1) inch in width. Each side of the emblem shall measure at least ten (10) inches.
3. 
A braking system maintained in good operating condition.
4. 
An adequate muffler system in good working condition, and a United States Forest Service qualified spark arrester.
5. 
A bicycle safety flag, which extends not less than seven (7) feet above the ground attached to the rear of the vehicle. The bicycle safety flag shall be triangular in shape with an area of not less than thirty (30) square inches and shall be dayglow in color.
