There is created and established the Department of Public Safety
for the City. The Department of Public Safety shall perform all of
the duties and responsibilities of the Police, Fire and Emergency
Management Departments of the City and shall have all the powers,
duties and responsibilities conferred upon the Police and Fire Departments
by virtue of the Municipal Code of the City or other ordinances of
this City or by State law and shall have such other and additional
powers, duties and responsibilities as may be lawfully imposed upon
it by any administrative directive, resolution, rule, ordinance or
law. The Department of Public Safety shall consist of a Director of
Public Safety and other such offices, ranks, members and/or chain(s)
of command as approved by the Mayor and Council.

There is established the office of Director of Public Safety.
The Director of Public Safety shall be the Chief of Police, Chief
of the Fire Department and the Director of Emergency Management in
and for the City. The Director of Public Safety shall exercise and
have all of the duties of these offices as such may be imposed or
authorized by ordinance or by law. The City may adopt additional duties
and regulations for such office not otherwise inconsistent with law.
The term and office of the Chief of Police, Chief of the Fire Department
and Director of Emergency Management, as used in any law or ordinance
of this City, shall mean the Director of Public Safety. The Director
of Public Safety is authorized to make and implement rules and regulations
in accordance and compliance with the laws and ordinances governing
the Police Department, Fire Department and Emergency Management Agency
of this City, to provide for the cross-training, mutual cooperation,
integration and consolidation of the Police Department, Fire Department
and Emergency Management Agency, all to implement the purposes of
this Article. The Director of Public Safety shall be selected and
appointed by the Mayor with the consent and approval of a majority
of the members elected to the City Council.

The Mayor may, with the consent of a majority of all the members elected to the Council, remove from office the Director of Public Safety at will; and any such officer may be so removed by a two-thirds (2/3) vote of all the members elected to the Council, independently of the Mayor's approval or recommendation. Any such removal shall be further regulated by any ordinance adopted by the Council governing removal of appointive officers under Section
115.070 of the Malden City Code.

Upon the recommendation of the Mayor and with the approval of
a majority of the members elected to the City Council, or by a two-thirds
(2/3) vote of all the members elected to the Council independently
of the Mayor's approval or recommendation, the City may hire, retain
or contract with such consultants and under such terms as deemed expedient
by the City.

All other subordinate officers and members of the Department
of Public Safety shall be appointed by the Director of Public Safety
under such policies, procedures and protocols as adopted by the City
Council.
