In order to ensure that the offices of Building Inspector and
Assistant Building Inspector are filled by a professional of excellent
ability and competency, it is important to draw candidates from as
large an area as possible. The fact that the Building Inspector and
Assistant Building Inspector are not electors of the Town will not
affect the performance of their duties and the attainment of the ultimate
goals of professionalizing Town management, increasing efficiency
and decreasing costs to taxpayers.
Notwithstanding any provision of any special, general or local
law to the contrary, the Building Inspector and Assistant Building
Inspector of the Town of Yorktown need not be a resident of the Town
of Yorktown, however, the Building Inspector and Assistant Building
Inspector shall be a resident of the State of New York,
This article is intended to supersede the provisions contained
in § 3 of the Public Officers Law of the State of New York
and § 23 of the Town Law of the State of New York otherwise
requiring the Building Inspector and Assistant Building Inspector
to be a resident/elector of the Town.
