A. 
General; Term; Removal. There shall be appointed a Borough Administrator, Borough Clerk, Borough Treasurer, Borough Tax Collector, Borough Tax Assessor, Borough Attorney, Borough Auditor, Borough Engineer, Zoning Officer and such other officers as the Council may deem necessary. They shall perform the duties required by the law and ordinances of the Borough. The Administrator, Attorney, Assessor, Construction Code Official, Building Inspector, Collector and Engineer are hereby specifically exempted from any residency requirement within the Borough. All the aforesaid officers shall serve and shall be subject to removal in accordance with the requirements of general law.
B. 
Method of Appointment. Appointment procedures are set forth in § 2-5-1E and G and § 2-6-1D.

A. 
Pursuant to N.J.S. 43:15C-2, the following positions are deemed to be eligible for and shall participate in the Defined Contribution Retirement Program:
(1) 
Business Administrator;
(2) 
Municipal Court Judge;
(3) 
Municipal Prosecutor;
B. 
Individuals serving in the following positions are exempt from Defined Contribution Retirement Program membership, pursuant to N.J.S. 43:15C-2:
(1) 
Certified Health Officer;
(2) 
Tax Collector;
(3) 
Chief Financial Officer;
(4) 
Construction Code Official;
(5) 
Qualified Purchasing Agent;
(6) 
Tax Assessor;
(7) 
Municipal Planner;
(8) 
Registered Municipal Clerk;
(9) 
Licensed Uniform Subcode Inspector;
(10) 
Principal Public Works Manager.
C. 
This section shall be implemented, construed and subject to N.J.S. 43:15C-1 et seq., as amended from time to time, and any regulations or guidance documents from the Local Finance Board or the Division of Pensions and Benefits.
