Pursuant to Act 247 of 1968, known as the "Pennsylvania Municipalities Planning Code," as amended, supplemented and in effect,[1] there is hereby created a Township Planning Commission, which shall have all the powers and duties conferred upon it by Act 247 and such other powers as are delegated to it by ordinance and/or resolution.

The Township Planning Commission shall consist of not less than three nor more than nine members, as the Board of Supervisors may from time to time determine by resolution. All members of the Township Planning Commission shall be appointed by the Board of Supervisors. Except for elected or appointed officers or employees of the Township, members of the Planning Commission may receive compensation in an amount fixed by the Board of Supervisors. Compensation shall not exceed the rate of compensation authorized to be paid to members of the Board of Supervisors. Without exception, members of the Planning Commission may be reimbursed for necessary and reasonable expenses. However, elected or appointed officers or employees of the Township shall not, by reason of membership thereon, forfeit the right to exercise the powers, perform the duties or receive the compensations of the municipal offices held by them during such membership on the Planning Commission.
The term of each of the members of the Planning Commission shall be for four years or until his successor is appointed and qualified, except that the terms of the members first appointed pursuant to this chapter shall be so fixed that on a Planning Commission of eight members or less no more than two shall be reappointed or replaced during any future calendar year, and on a Commission of nine members not more than three shall be so reappointed or replaced. The Chairman of the Planning Commission shall promptly notify the appointing authority of the municipality concerning vacancies in the Commission and such vacancies shall be filled for the unexpired term.
The members of any existing Planning Commission established under former ordinances shall continue in office until the end of the term for which they were appointed and their successors shall be appointed as provided by this chapter.
All of the members of the Planning Commission shall be residents of the Township of Sadsbury.
Any member of the Planning Commission, once qualified and appointed, may be removed from office for malfeasance, misfeasance or nonfeasance in office or for any other just cause by a majority vote of the Board of Supervisors. The member shall receive 15 days' advance notice of the intent of the Board of Supervisors to take such a vote and a hearing shall be held in connection with the vote if the member so requests it in writing.
The Planning Commission shall have the power and duties to do everything outlined in Section 209.1 of Act 247 of 1968, the Municipalities Planning Code, as amended,[1] and any other power and duty consistent with its mandated authority or duties delegated to it by the Board of Supervisors, and shall not have the power to grant formal approval, but its determination shall be recommending only and not formal action on plans.
