There shall be a municipal court which shall have jurisdiction
to hear and determine violations of the ordinances of the City. Ref.
K.S.A. 12-4104.
The municipal judge shall possess the qualifications required
by law to serve as municipal judge. The municipal judge shall be selected
as provided by ordinance.
The municipal judge shall have such powers and duties as set
forth in the Kansas code of procedure for municipal courts (K.S.A.
12-4101 et seq. and all acts amendatory or supplemental thereto).
The municipal judge shall receive a salary as shall be fixed
by ordinance.
The court clerk shall receive and safely keep all cash bonds
subject to the order and direction of the municipal judge concerning
the disposition thereof. The court clerk shall have no authority other
than to hold cash bonds posted with him or her according to law and
to deliver the same to the municipal judge or such other City officer
as the judge may direct.
In addition to witness fees, mileage and assessments as provided
by state statute, the imposition of which the Court is authorized
to impose as costs, in each case filed in the Municipal Court of Mission
Woods, Kansas, where there is a finding of guilty or a plea of guilty,
a plea of no contest, forfeiture of bond or diversion, the Court shall
assess court costs in the amount of $25 for such case. (Ord. 161)
The governing body shall provide at the expense of the City
a suitable room or office for the municipal judge and court shall
be held in such room and the court shall be open every day except
Saturdays and Sundays. Municipal court shall be held at the Westwood
City Hall unless circumstances make that place impracticable for a
particular session, in which case it may be held at any convenient
place. Ref. K.S.A. 12-4109.
Except as otherwise provided herein, the Kansas code of procedure
for municipal courts, as set forth in K.S.A. 12-4101 et seq. and all
acts amendatory or supplemental thereto shall govern the practice
and procedure in all cases in the municipal court.
