By virtue of the provisions of the Borough Code of the Commonwealth of Pennsylvania, Borough Code, 8 Pa.C.S.A. § 101 et seq., there is hereby established a Recreation Board in the Borough of Swoyersville, Pennsylvania, hereinafter referred to as the "Board."
Such Board shall have the power to supervise, operate and maintain public parks, playgrounds, play fields, swimming pools and all indoor and outdoor recreation areas and facilities owned or controlled by the Borough of Swoyersville and located in said Borough of Swoyersville, subject to all responsibilities contained in said Act of Assembly and any amendments thereto. Such operations are subject to review by said Borough Council of Swoyersville.
Such Board shall be composed of nine members, who shall be residents of said Borough of Swoyersville.
The first members of said Board shall be appointed by the Borough Council of Swoyersville as soon as practicable after the adoption of this chapter. The first- and second-named members thereof shall serve for a term of five years, the third and fourth members thereof shall serve for a term of four years, the fifth and sixth members thereof shall serve for a term of three years, the seventh and eighth members thereof shall serve for a term of two years, and the ninth member thereof shall serve for a term of one year, or in each case until their respective successors have been appointed and qualified.
All subsequently appointed members to said Board shall serve for terms of five years or until their successors are appointed and qualified.
Removal from the Borough of Swoyersville shall make a member of such Board ineligible to continue membership therein.
Vacancies in the membership of said Board shall be filled by the Borough Council of Swoyersville for the unexpired portion of the term for which the appointment is made.
Members of the Board shall serve without compensation.
The member of the Council of the Borough of Swoyersville who is appointed to be in charge of recreation shall be the Executive Director of the Board, and he shall appoint, with the approval of said Borough Council, other personnel as may be deemed necessary.
The members of the Recreation Board shall elect from their membership a Chairman and a Secretary and all other necessary officers to serve for a period of one year. Such Board shall have power to adopt rules and regulations for the conducting of all business within its jurisdiction.
Funds appropriated by the Borough Council of Swoyersville and budgeted to the Recreation Board shall be disbursed by the fiscal disbursing officer of the Borough of Swoyersville upon vouchers issued by the Recreation Board and within the budget appropriations made. Funds received by the Recreation Board from sources other than budget appropriations shall be deposited by the Executive Director to the credit and for the use of said Board, and disbursed as the above budget funds are disbursed.
The Board shall make full and complete reports to the Borough Council of Swoyersville of its operations at such times as may be designated or requested by said Borough Council. The fiscal year of said Board shall conform to that of the Borough of Swoyersville.
