This article shall be entitled "A Local Law Changing the Residency Requirement for the Office of Deputy Clerk II."
The intent of this article is to allow the Town Clerk or the Town Board, as the case may be, to appoint a Deputy Town Clerk who is not a resident of the Town of Pleasant Valley.
This article is enacted pursuant to § 10 of the Municipal Home Rule Law.
The first Deputy Town Clerk of the Town of Pleasant Valley must keep residency requirements, and any additional Deputy Town Clerks appointed pursuant to § 30, Subdivision 10(a) and/or (b), of the Town Law, at the time of his or her appointment and throughout his or her term of office, need not be an elector of the Town of Pleasant Valley, but must be a resident of Dutchess County.
This article is intended to supersede the residency requirements contained in § 23, Subdivision 1, of the Town Law, § 3, Subdivision 1, of the Public Officers Law, and any local law of the Town of Pleasant Valley which requires the Deputy Town Clerk to be an elector of the Town of Pleasant Valley.
This article shall become effective immediately upon its filing in the office of the New York State Department of State.
