All fishing and hunting, and all boats, aquaplanes or surfboards, jet skis, or other similar devices used and operated in or on the waters of municipal lakes, including Lake Kaufman and adjacent property, by every person, shall be carried on, used and operated under the following restrictions:

Council may prohibit use.
The city council shall at all times have full power and authority to prohibit the use of the lakes belonging to the city for the purpose of fishing, and also for the operation of boats, aquaplanes, surfboards, jet skis, or similar devices in or on such waters, should it become necessary, in the opinion of the city council, to do so for the purpose of suppressing and arresting any epidemic or any contagious or infectious disease; or whenever, in the opinion of the city council, the use and operation of boats, aquaplanes, surfboards, jet skis, or any other similar device, or the use of such waters for the purpose of fishing, should be discontinued for any reason whatsoever. Subject to such control and supervision, the reservoirs of the city shall be controlled and maintained for recreational purposes by the city council.
(2)
Intoxication.
It shall be unlawful for any person to go upon the waters of the lakes of the city or to ride in or on or operate a boat, aquaplane, surfboard, jet ski, or other similar device upon the waters of the city while under the influence of any substance introduced into the body that results in the disturbance of the person's mental or physical capacity. Upon the conviction of any person for operating a boat, aquaplane, surfboard, jet ski, or other similar device upon the waters of such lakes while intoxicated, such person shall forfeit his license to operate the same, or his right to hunt or fish. Such person shall not again receive such license, except upon an order of the city council.
(3)
Hunting on Lake Kaufman.
All hunting and the carrying of firearms on Lake Kaufman are prohibited, except for shotguns for the hunting of migratory waterfowl and doves in season.
(4)
Manner of operation of boats and watercraft.
Every person using or operating a boat, aquaplane, surfboard, jet ski, or other similar device, of any character or description, upon such waters shall use and operate the same in a careful and prudent manner so as not to collide with or come in contact with any other boat, aquaplane, surfboard, jet ski, or other similar device being used or operated in such waters, and so as to avoid accident and injury to any person or damage to property. Failure to use and operate any boat, aquaplane, surfboard, jet ski, or other similar device in such waters in a careful and prudent manner so as to avoid accident and injury to person or damage to property shall constitute an offense.
