All fishing and hunting, and all boats, aquaplanes or surfboards, jet skis, or other similar devices used and operated in or on the waters of municipal lakes, including Lake Kaufman and adjacent property, by every person, shall be carried on, used and operated under the following restrictions:
(1) 
Council may prohibit use.
The city council shall at all times have full power and authority to prohibit the use of the lakes belonging to the city for the purpose of fishing, and also for the operation of boats, aquaplanes, surfboards, jet skis, or similar devices in or on such waters, should it become necessary, in the opinion of the city council, to do so for the purpose of suppressing and arresting any epidemic or any contagious or infectious disease; or whenever, in the opinion of the city council, the use and operation of boats, aquaplanes, surfboards, jet skis, or any other similar device, or the use of such waters for the purpose of fishing, should be discontinued for any reason whatsoever. Subject to such control and supervision, the reservoirs of the city shall be controlled and maintained for recreational purposes by the city council.
(2) 
Intoxication.
It shall be unlawful for any person to go upon the waters of the lakes of the city or to ride in or on or operate a boat, aquaplane, surfboard, jet ski, or other similar device upon the waters of the city while under the influence of any substance introduced into the body that results in the disturbance of the person's mental or physical capacity. Upon the conviction of any person for operating a boat, aquaplane, surfboard, jet ski, or other similar device upon the waters of such lakes while intoxicated, such person shall forfeit his license to operate the same, or his right to hunt or fish. Such person shall not again receive such license, except upon an order of the city council.
(3) 
Hunting on Lake Kaufman.
All hunting and the carrying of firearms on Lake Kaufman are prohibited, except for shotguns for the hunting of migratory waterfowl and doves in season.
(4) 
Manner of operation of boats and watercraft.
Every person using or operating a boat, aquaplane, surfboard, jet ski, or other similar device, of any character or description, upon such waters shall use and operate the same in a careful and prudent manner so as not to collide with or come in contact with any other boat, aquaplane, surfboard, jet ski, or other similar device being used or operated in such waters, and so as to avoid accident and injury to any person or damage to property. Failure to use and operate any boat, aquaplane, surfboard, jet ski, or other similar device in such waters in a careful and prudent manner so as to avoid accident and injury to person or damage to property shall constitute an offense.

All boats, aquaplanes, surfboards, jet skis, or other similar devices, of every kind and description, that are not anchored or are loose shall be impounded in accordance with the provisions of this section. The owner of such boat, aquaplane, surfboard, jet ski, or other similar device, in retrieving the same from the possession of the impounding officer, shall pay a fee as set forth in the fee schedule in appendix A of this code. If the boat, aquaplane, surfboard, jet ski, or other similar device is not redeemed or retrieved within two weeks after impoundment, it shall be sold under the provisions of this section, for which a fee as set forth in the fee schedule in appendix A will be charged.

It shall be unlawful for any person to seine for minnows or use a seine for any purpose within the waters of the municipal lakes, including Lake Kaufman.

Boats of every kind, character and description used and operated in waters belonging to the city shall at all times be equipped with approved Coast Guard life preservers for each passenger on board. It shall be the duty of the owners and operators of such boats to provide life preservers for each person and passenger using and operating the boats.

It shall be unlawful for a speedboat, jet ski, or motorboat to go or travel at a speed greater than five miles per hour on all the waters belonging to the city, except Lake Kaufman. It shall be unlawful for a speedboat, jet ski, or a motorboat to go or travel within the territory marked by buoys or signs at a speed greater than the signs provide.

All automobiles and trailers used within prohibited areas of the waterfront for the purpose of loading and unloading boats shall be removed from such prohibited areas when loading or unloading has been completed. Prohibited areas are those areas designated by signs and other similar devices or markers set by the chief of police for the purpose of the safety and health of the people using the waters of the lakes.

(a) 
Fishing and related boating activity shall be permitted in and on the City Lakes Park. All boats shall have no more than ten horsepower motors.
(b) 
The following rules and regulations shall apply as to the means and methods of taking fish:
(1) 
All trotlines shall be rubberband trotlines.
(2) 
Pole and line, rod and reel, artificial and natural baits, hand line, jug line, or throwline and rubberband trotlines, hooks on throwlines and rubberband trotlines must be spaced not less than three horizontal feet apart.
(3) 
Not more than 20 hooks altogether may be used in any combination of the following: pole and line, rod and reel, artificial and natural bait, jug line, throwline, and rubberband trotlines.
(c) 
The City Lakes Park, which has been designated for fishing and related boating activities, shall be subject to the statutes, rules, regulations, policies or any laws whatsoever propounded by the state in the state Parks and Wildlife Code or otherwise.
(d) 
There shall be no hunting permitted on the City Lakes Park and adjoining city property unless permitted and authorized by the city manager or his designee in order to abate nuisances of wild animals that endanger the park.
(e) 
The fees set forth in the fee schedule in appendix A of this code shall be charged by the city for purposes of granting a license to use City Lake Park and Lake Kaufman for fishing and related boating activities. The licensee shall include only the individual who obtains a permit for fishing or boating related activities except for children under 12 years of age or younger or individuals 65 years of age or older for which no fees are charged.
(f) 
This section and its provisions shall apply to the City Lakes Park on Highway 34 and Lake Kaufman on Highway 243. If any conflict should arise as a result of a previous ordinance, the terms of this section shall prevail.

It shall be unlawful for any person to swim or bathe in the waters of the municipal lakes of the city, including Lake Kaufman.

(a) 
Vehicle operation shall not exceed 15 mph at Lake Kaufman.
(b) 
All motorized vehicles shall be confined to the parking area only. Parking is permitted only in authorized or designated areas.
(c) 
All motorized vehicles are prohibited from Lake Kaufman except as provided in subsections (a) and (b) above. Motorized vehicles will include but not be limited to all-terrain vehicles (ATVs), four-wheelers and motorbikes.
