(a)
All lots shall be held and used in accordance with the ordinances of the city and the rules and regulations of West Hill Cemetery and West Hill Annex, now in force and hereafter adopted.
(b)
Lots and portions thereof shall be used as burial places for human remains and personal possessions of the deceased.
(c)
Lot holders shall not allow interments to be made upon their lots for a compensation, nor shall any transfer or assignment of any lot or interest therein be valid without first obtaining the consent of the superintendent of the cemetery and all bills against said lot owner are paid. Approved transfers or assignments must be duly entered of record with the city clerk.
(d)
No lot or parcel of ground shall be defined by any fence, railing, coping, hedge, embankment, curb, border or ditch, nor shall any seat, rock-work or wire-work or any architectural object be erected, except as hereinafter specified.
(e)
Mounds over grave spaces that require frequent maintenance can be created only after approval of the superintendent.
(f)
No advertisement or solicitation of any kind whatsoever will be permitted within the cemetery.
(g)
The city reserves the right to remove from any lot or portion thereof anything that conflicts with the rules and regulations.
(h)
The superintendent of the cemetery has entire charge of the cemetery and he is authorized to enforce all rules to maintain order; to overlook all workmen, visitors and drivers; and to expel those who disregard his orders. The superintendent of the cemetery is further authorized to inspect any and all materials when necessary, and to insist on the immediate removal of all trash and building material as soon as buildings or monuments are completed or erected.
(i)
The city will perpetually care for and maintain all roads, paths, vegetation, lots, grounds, and shrubbery. However, lot owners must care for and maintain all markers, monuments, vaults, etc., erected on their lots.
(j)
All charges for interments, graves, excavation for vaults, and other cemetery expenses must be paid for in advance unless billed through a burial service provider (BSP).
(k)
Should there be an interment on a lot not fully paid for, the city has the right to disinter the body or bodies to a lot or burial space equal to the value that has been paid on said lot.
(l)
When there are two (2) or more persons interested as owners of a lot, no division line on said lot will be permitted or recognized by the city, as all lot owners have equal right of interment.
(m)
All work of whatever nature, except the erection of markers, monuments, vaults, etc., shall be performed by the employees of the cemetery and under the direct supervision of the superintendent of the cemetery or his representative.
