(a) 
All lots shall be held and used in accordance with the ordinances of the city and the rules and regulations of West Hill Cemetery and West Hill Annex, now in force and hereafter adopted.
(b) 
Lots and portions thereof shall be used as burial places for human remains and personal possessions of the deceased.
(c) 
Lot holders shall not allow interments to be made upon their lots for a compensation, nor shall any transfer or assignment of any lot or interest therein be valid without first obtaining the consent of the superintendent of the cemetery and all bills against said lot owner are paid. Approved transfers or assignments must be duly entered of record with the city clerk.
(d) 
No lot or parcel of ground shall be defined by any fence, railing, coping, hedge, embankment, curb, border or ditch, nor shall any seat, rock-work or wire-work or any architectural object be erected, except as hereinafter specified.
(e) 
Mounds over grave spaces that require frequent maintenance can be created only after approval of the superintendent.
(f) 
No advertisement or solicitation of any kind whatsoever will be permitted within the cemetery.
(g) 
The city reserves the right to remove from any lot or portion thereof anything that conflicts with the rules and regulations.
(h) 
The superintendent of the cemetery has entire charge of the cemetery and he is authorized to enforce all rules to maintain order; to overlook all workmen, visitors and drivers; and to expel those who disregard his orders. The superintendent of the cemetery is further authorized to inspect any and all materials when necessary, and to insist on the immediate removal of all trash and building material as soon as buildings or monuments are completed or erected.
(i) 
The city will perpetually care for and maintain all roads, paths, vegetation, lots, grounds, and shrubbery. However, lot owners must care for and maintain all markers, monuments, vaults, etc., erected on their lots.
(j) 
All charges for interments, graves, excavation for vaults, and other cemetery expenses must be paid for in advance unless billed through a burial service provider (BSP).
(k) 
Should there be an interment on a lot not fully paid for, the city has the right to disinter the body or bodies to a lot or burial space equal to the value that has been paid on said lot.
(l) 
When there are two (2) or more persons interested as owners of a lot, no division line on said lot will be permitted or recognized by the city, as all lot owners have equal right of interment.
(m) 
All work of whatever nature, except the erection of markers, monuments, vaults, etc., shall be performed by the employees of the cemetery and under the direct supervision of the superintendent of the cemetery or his representative.

(a) 
The setting of more than one (1) monument, marker, or gravestone on any single grave space is prohibited without approval from the superintendent. Flat monuments, markers and gravestones are required in the section of the cemetery known as the Memorial Section and are permitted throughout the cemetery upon prior approval of the superintendent of the cemetery.
(1) 
Monuments planed in Annex D shall be flat or slant style (bases are permitted). Combined height shall be no higher than fourteen (14) total inches above ground.
(b) 
Granite and standard bronze are recommended for all monuments. Limestone, sandstone, soapstone, slate, artificial stone, clay or sand brick, concrete and metal (other than standard bronze) will not be permitted.
(c) 
The design and detail plans of all monuments, vaults, mausoleums, and other structures and any writings, pictures, symbols or designs thereon must be submitted in advance to the superintendent for approval. The city reserves the right to reject any writings, pictures, symbols or designs that are vulgar or obscene and any such structure that will interfere with the general effect or maintenance of the cemetery or which does not conform with its rules and regulations.
(d) 
No material for monuments or other structures is permitted on the cemetery grounds unless brought by workmen employed by lot owners to properly place the same. Lot owners will be held responsible for all injuries or damages incurred by persons employed by them.

(a) 
Fresh cut flowers, artificial flowers, wreaths, potted plants, baskets, or paper are permitted at the grave site. The city and the cemetery are not responsible for the care or safety of any items placed at a grave site. Discarded, damaged, faded, torn or unsightly items at a grave site shall be immediately removed and placed in appropriate containers.
(b) 
No tree, shrub, bush, plant, flowers or similar items shall be planted on or around a grave or lot locations. No existing planted tree, shrub, plant, flowers or bush shall be disturbed, damaged or removed.
(c) 
The city and the cemetery reserve the unconditional right to remove any and all unsightly, damaged, faded or torn items from around or on grave or lot locations.

(a) 
The city requires a minimum of twenty-four (24) hours notice of intended burial before an interment can be scheduled. The notice shall be given during regular business hours (Monday– Friday, excluding holidays, 8:00 a.m.–5:00 p.m.).
(b) 
The city requires information from the arranging BSP to include the deceased individual’s name, lot identification, date of death, date/time of burial and type of container. The city also requires that a licensed mortician certify or attest to the remains being placed in interment. This record will be tabulated and entered of record with the city clerk and will constitute a permanent record.
(c) 
Any lot holder has the right to give permission by written order for the burial of the remains of others than his immediate family, but not for monetary consideration, sale or hire of space.
(d) 
One (1) interment only may be made in each grave, excepting in the case of cremated remains or a parent with his/her infant child or two (2) children buried at the same time. The simultaneous burial shall be allowed within another’s casket with prior approval of the superintendent of the cemetery.
(e) 
Undertakers, drivers and all other employees at funerals are under the control of and subject to the direction of the superintendent of the cemetery or his assistants.

(a) 
Hours of access to the cemetery shall be from sunrise to sunset.
(b) 
All persons are prohibited from gathering flowers or breaking any tree, shrub or plant, or writing upon or desecrating any monument, fence, or other structure in or belonging to the cemetery.
(c) 
No assemblies, other than funerals, are permitted, unless prior consent of the superintendent is obtained.
(d) 
The possession or consumption of alcoholic beverages, including beer, wine, liquor, etc., is not permitted in any part of the cemetery grounds.
(e) 
The legal speed for any and all vehicles shall not be in excess of ten (10) miles per hour in any part of the cemetery grounds.
(f) 
No driver, operator or other person in charge of any vehicle except cemetery personnel shall drive in or on any portion of the cemetery grounds, except in or on duly laid out roads.
(g) 
No firearms, air guns or BB guns are allowed in the cemetery except as a part in an official funeral ceremony or by a licensed peace officer.
(h) 
Horses are permitted within the cemetery grounds, but at no time shall they be left unattended. No hitching is permitted without prior approval from the superintendent of the cemetery.
(i) 
All animals must be on a leash and cleanup is required according to sections 2.01.004 and 2.01.017 [articles 2.02 and 2.03] of this code.
(j) 
Visitors are reminded that the grounds are sacredly devoted to the interment of the dead, and that a strict observance of proper decorum will be required by all.
(k) 
The officers and agents of the city are authorized and directed to regulate or forbid the entry of any person or persons who have no legal reason to be therein. Furthermore, the officers and agents of the city are authorized and directed to remove all persons who commit any decorum violation or who violate any of the rules or regulations set forth herein.

(a) 
A person commits an offense if the person violates any provision of sections 1.08.031 through 1.08.035, above. An offense under these sections is a class C misdemeanor, and each day that a violation occurs is a separate offense.
(b) 
A person who violates any provision of section 1.08.031, is liable for a civil penalty of not less than two hundred dollars ($200.00) and not more than one thousand dollars ($1,000.00) for each day the violation continues and shall be subject to being enjoined by the city attorney from committing future violations.

(a) 
If a body is not embalmed, or if a body is in a state of decay where it cannot be embalmed and where in the opinion of duly authorized persons such body should be interred immediately, such burial shall be permitted to take place.
(b) 
If, in the opinion of the health officer or a practicing physician, a person has died of a communicable disease his body shall be buried immediately.
(c) 
No Sunday funerals will be permitted in West Hill Cemetery except as outlined in this section.

(a) 
Payment in full is due on or before the 25th day of the month following the invoice date.
(b) 
If the customer account has a balance that is ninety (90) days past due from the invoice date, privilege of using the city cemetery services may be discontinued.
(c) 
A late fee of five percent (5%) will then be assessed against the unpaid balance of the BSP account not paid in full within ninety (90) days from the invoice date and the account may be referred for collection.
