A. 
No person, firm corporation or partnership shall install, operate, replace, modify or perform work of any other nature on any water and/or sewer service connection piping or fixture under the control of the Borough of West Wildwood without first having obtained and being in possession of a valid permit to do such work issued by the Borough Clerk's Office and the appropriate permit fee listed on Schedule "A"[1] and posting sufficient security and inspection escrow.

B. 
Any permit issued pursuant to this article shall become null and void unless work is commenced pursuant to the permit within 30 days of issuance of said permit, unless the applicant has sought and received an extension from the Borough Clerk's office for commencement of the work.
C. 
Unless otherwise required by an emergency, the Borough Clerk's office shall not issue a permit for the opening or excavation of any street under the control of the Borough where such street has been resurfaced or replaced within five years prior to the date of application for the permit. Any such emergency must be so certified by the Borough Commissioner of Public Works.

D. 
Any emergency repair implemented or valve operation without a permit shall require an after the fact permit application and such a permit may require additional scheduled work to be performed so as to assure facilities in place conform to this article.
E. 
Subsequent to acquiring the necessary permits, the applicants must give 24 hours' notice to the Borough Clerk's office before commencement of any work.
F. 
Applications for the installation operation, replacement or modification of water and/or sewer service connections under the control of the Borough by Borough personnel can be accepted and scheduled by the Commission of Public Works if Borough manpower and equipment allows. The fees for such work to be performed by the Borough shall be the appropriate permit fee listed on Schedule "A" plus the fee listed on Schedule "B."[2] The application must be accompanied by an application for road/street opening and all applicable fees.

All applicants for the installation, relocation, repair, modification of water and/or sewer service facilities that are within the public right-of-way shall prepare and file with the Borough Clerk an application obtained from the Clerk's office. The application shall be accompanied by a plan or drawing describing the location and description of the facility to be installed repaired relocated or modified. Permits for the operation of valves do not require plans or drawings.
A. 
Plans shall provide the depth of cover or elevation of the proposed and/or existing utilities or structure. If the elevation of an existing utility or structure that is to remain subsequent to the proposed work is unknown, then as-built information is to be added to the plans and a copy provided to the Borough following completion of work.
B. 
The plans for buried utilities and structures shall provide the location of the proposed and/or existing utilities and structures relative to the curbline. When no curb exists, the edge of the right-of-way shall be used in its place.
C. 
Proposed structures and utilities shall not be installed collinearly above or below existing or proposed Borough storm drains, water mains and sewer mains. A horizontal clearance of two feet between all mains and services shall be maintained unless specific approval is obtained from the Borough Engineer.

The requirements of Chapter 482, Article I, Street Encroachments and Openings, of the Borough Code, shall apply to all work within the municipal right-of-way.
The following standards shall govern the installation, relocation, modification, repair, and replacement of water service and sanitary sewer lateral connections under the control of the Borough.
A. 
Location of existing utilities. Prior to any excavation, the contractor shall bear the responsibility for locating and marking either by paint on the pavement or placement of stakes in the ground the location of all water services, gas services, gas mains, water mains, sewer mains, telephone and electric raceways or conduits, and drains within the area to be excavated.
B. 
Pavement cutting. Pavement shall be cut with pneumatic hammers or mechanical pavement cutters, saws or other methods approved by the Borough Engineer or Commissioner of Public Works.
C. 
Trench excavation and backfilling. The excavation and backfill of trenches within the public right-of-way shall conform to the requirements of Chapter 482, Article I, Street Encroachments and Openings, as adopted and amended.
D. 
Street restoration. Street restoration shall be in accordance with Chapter 482, Article I, Street Encroachments and Openings, with the exception of work within the Glenwood Avenue in which case the Cape May County Road Opening Ordinance shall apply.
E. 
Water services.
(1) 
The water service from the water main extending to outlet of the meter setter is the portion of water service under the control of the Borough. The portion of the water service under the control of the Borough shall include the following:
(a) 
The corporation stops shall be Ford type F600 corporation stops with insert stiffener and either eighth or quarter swivel bends with pack joint outlets.
(b) 
Service pipe shall be polyethylene water service tubing SDR-9 conforming to ASTM-D-2737.
(c) 
A Ford type ball curb stop with insert stiffeners shall be installed without a curb box on the inlet side of the meter setter.
(d) 
The meter setter shall have an inlet valve and double-check valve copper setter with pack joint assemblies and insert stiffeners.
(e) 
The meter box shall be a polyvinyl chloride (PVC) box 18 inches in diameter and 30 inches in height with a minimum wall thickness of 0.225 inches.
(f) 
The meter box cover shall be Ford No. A32H with a weight of 32 pounds.
(g) 
The water meter which is the property of the Borough will be supplied by the Borough. The removal of the meter from the meter setter by other than Borough personnel is forbidden. The water meter is to be located approximately nine feet behind the curbline, one foot from the property line. The water meter pit is may not be located within a driveway without the approval of the Borough Engineer.
(2) 
No person shall remove a water meter from the meter setter or operate the inlet valve of the copper setter without notifying the Borough and securing the required permit under this article.
(3) 
No person with the exception of Borough personnel shall disassemble, remove, bypass or in any way defeat the operation of a meter or meter outlet check valve.
F. 
Sewer service laterals.
(1) 
The sewer lateral from the sewer main extending to the point where the lateral crosses the right-of-way line is the portion of sewer lateral under the control of the Borough. The portion of the sewer lateral under the control of the Borough shall be six-inch diameter PVC (polyvinyl chloride) pipe and fittings conforming to ASTM specification D-3034 (SDR-35) type PSM.
(2) 
A sewer cleanout shall be installed one foot prior to the sewer lateral passing out of the right-of-way and prior to any reduction in the size of the lateral piping.
(3) 
All pipe joint including the cap or plug shall be watertight. The cleanout shall be keep sealed except during maintenance work on the lateral. The cleanout may not be located within an unpaved driveway. The cleanout may be located within a paved driveway or other paved surface if a cleanout cover is provided so that no contact is made between the paved surface and the piping. The cleanout cover shall be a model R-1792-AL casting as manufactured be Neennah Foundry Company, or an equal approved by the Borough Engineer.
(4) 
No flexible pipe coupling such as a Fenco type fitting shall be used between the cleanout and the main.
(5) 
All work shall be in conformance with ASTM standard D-2321.
A. 
Every application shall be accompanied by a maintenance bond in the amount specified in Schedule "A."[1] If no bond is provided a certified check in the same amount or a minimum of $75 shall be provided with the application.

B. 
A construction company, in lieu of giving a separate bond for each project, may annually, once in January of each year, post a bond in an amount sufficient to encompass the estimated work performed by said company during the ensuing calendar year. In the event that the total bond requirements for all outstanding permits of a company exceed the posted bond amount, additional bonds and/or cash security will be required.
C. 
The purpose of depositing the maintenance bond, surety bond or cash is to guarantee to the Borough of West Wildwood that any damage to the Borough water and sewer facilities can be repaired without incurring unplanned cost and to assure completion of the work for which the permit was secured. The Borough upon finding damage to its facilities or work that does not meet the requirements of this article shall be entitled, after reasonable notice to the applicant to correct such deficiencies, to take the maintenance bond, surety bond or cash posted by the applicant and utilize them to correct any damage or deficiencies that arose due to the work under taken under the permit.
A. 
Every application for water and sewer facilities permits under the control of the Borough of West Wildwood, shall be accompanied by a certificate of insurance demonstrating that the applicant possesses personal injury liability insurance in the amount of $500,000 and property damage liability insurance in the amount of $250,000. Said insurance shall be maintained by the applicant during the period of construction or excavation.
B. 
The applicant shall also agree in writing to indemnify and hold harmless the Borough of West Wildwood, its agents, servants and employees from any damage or liability sustained by any person or property arising out of the negligence of the applicant or its agents, servants and employees during the course of any construction, or procedure performed on a water or sewer service under the control of the Borough of West Wildwood. Said agreement shall require the applicant in the event a claim is made against the Borough of West Wildwood, its agents, servants and employees arising out of the applicant's construction activities, to provide the Borough of West Wildwood with a legal defense and to pay any and all attorneys' fees or costs incurred by the Borough of West Wildwood in connection with any claims, suit or litigation.
A. 
The work shall be performed between the hours of 7:00 a.m. and 7:00 p.m. In emergent situations, with a determination of an emergency being in the sole discretion of the Public Works Commissioner, this requirement may be waived under those terms and conditions to be set by the Public Works Commissioner.
B. 
When any work is done on a weekend by a contractor, the inspection would be done by the Borough and must be paid for by the applicant at those rates to be set by the Borough.
A. 
Any person, firm, corporation or partnership violating any provision of this article shall be subject to one or more of the following: a fine of not more than $2,000, imprisonment for not more than 90 days or a period of community service for not more than 90 days.

B. 
Any person, firm, corporation or partnership violating the provisions of this article shall not obtain a permit under this article for a three-year period.
