An Environmental Commission pursuant to N.J.S.A. 40:56A-1 et
seq. shall hereby be established for the Borough of West Wildwood.
The Commission shall consist of seven members, to be appointed
by the Mayor, one of whom shall be a member of the Borough Planning
Board, and all of whom shall be residents of the Borough.
The Mayor shall designate one of the members to serve as Chairman
and presiding officer of the Commission.
The terms of office of the first Commissioners appointed shall
be for one, two or three years, to be designated by the Mayor so that
the terms of approximately one-third of the members will expire each
year, and their successors shall be appointed for a term of three
years and until the appointment and qualifications of their successors.
The members of the Commission shall serve without compensation
except as otherwise may be provided under the provisions of N.J.S.A.
40:56A-1 et seq.
The Mayor or Board of Commissioners of the Borough may remove
any member of the Commission for cause on written charges served upon
the member and after a hearing thereon at which the member shall be
entitled to be heard in person or by counsel.
A vacancy on the Commission occurring other than by expiration
of term shall be filled for the unexpired term in the same manner
as the original appointment.
The Environmental Commission shall have all of the powers, responsibilities
and duties as set forth in N.J.S.A. 40:56A-1 et seq., including the
power to conduct studies and make recommendations to the Borough Planning
Board and to the Board of Commissioners of the Borough regarding open
space preservation, water resource management, air pollution control,
solid waste management, noise control, soil and landscape protection,
environmental appearance, marine resources, and the protection of
flora and fauna.
The Environmental Commission shall keep records of its meetings
and activities and shall make an annual report to the Board of Commissioners
of the Borough.
The Board of Commissioners may appropriate funds for the expenses
incurred by the Environmental Commission as it deems necessary and
appropriate.
