Only humane live animal traps may be used for capturing animals roaming unrestrained in the city. It shall be unlawful for any person to place, set or bait any trap for the purpose of catching, wounding or killing any animal, fowl or reptile without the permission and assistance of a city animal control officer. This section, however, does not preclude the use of commercially sold rat and mouse traps, to be utilized as intended by the manufacturer in accordance with the manufacturer’s direction for use, in that person’s residence, accessory structure or commercial establishment.

The placing or baiting of any steel jawed trap (commonly known as a bear trap, wolf trap or coyote trap) within the corporate limits of the city is expressly prohibited. As an exception to this subsection, governmental agencies and entities shall be permitted to use such traps and equipment necessary and permitted by state law or regulations.

Any animal traps found on public property are hereby declared to be abandoned, and the city enforcement agents are hereby authorized and directed to seize any such trap and process the same as abandoned property in accordance with the applicable provisions of state law and city procedures.

It shall be a violation of this chapter to use anything other than commercially sold animal food to bait any trap used for the purpose of trapping any animal. Unless the adjacent properties are separated by a solid masonry or wood fence of a minimum six foot (6) height, traps used for such purpose shall not be placed or located within ten feet (10') of adjacent property lines. In the event no such fence exists and the size, shape or other characteristics of the property preclude traps from being placed or located ten feet (10') from adjacent property lines, said traps shall be placed or located as far from adjacent property lines as practicable.
