As use in this chapter, the following words have the meanings indicated:
LOITER
To be dilatory, slow in movement and/or to linger or stand around.
MALICIOUS
Done willfully, intentionally and without legal justification, cause or excuse.
PROWL
To appear to be searching, using stealth, being quiet and/or being secretive.
A. 
From and after the passage of this chapter, it shall be unlawful to maliciously prowl or maliciously loiter in, around, near, or on the property of another and without the consent of such owner, any equipment, excavation or building other than a dwelling house or other place used wholly or partly for living or dwelling purposes.
B. 
It shall be unlawful to maliciously prowl or maliciously loiter in, around or near any park or playground area, public recreation building, public school or other public use area within the Township. Such areas will be open from 9:00 a.m. until 9:00 p.m., seven days a week. They shall be closed during other others.
C. 
In lighted areas such as tennis courts or certain municipal park areas, supervised playground activities and/or supervised organized sports activities are permitted during other hours, but only during such time as such areas are lighted. Permission may be granted by the supervisors or persons in charge of the municipal parks, in writing, for other appropriate activities.
A. 
Whoever violates § 278-2 of this chapter shall, upon conviction thereof, be fined a minimum of $25 and a maximum of $300, and/or be sentenced to not more than 10 days in the County Jail. The offender shall also pay the costs of prosecution. In default of such payment, such person shall be imprisoned in the County Jail for a period not to exceed 10 days. Each day during which any violation of § 278-2 continues shall constitute a separate offense.
B. 
Should the offender, as referenced above, be a juvenile, then the authorities charged with enforcement responsibility for a violation of this chapter may remand the offender into the custody of his or her parents and/or proceed as provided by the Pennsylvania Rules of Criminal Procedure pertaining to summary offenses and the Juvenile Act.[1]

The Township of Harborcreek shall empower whatever police agency they may to enforce the provisions of this chapter. Included among the available police agencies are the Pennsylvania State Police and Code Enforcement Officers of the Township of Harborcreek.
All other acts or ordinances inconsistent with the provisions of this chapter are hereby repealed by the passage of this chapter.
