As used in this chapter, the following terms shall have the
meanings indicated:
DRIVEWAY
Includes the culvert if there shall be one and shall mean
that part of a driveway within a public road.
All driveways, whether temporary or permanent, which lead from
Township Roads and so cross the drainage ditch along the side of said
Township roads come within the scope of this chapter.
Driveways shall be so constructed and maintained that at no
time do they offer or create an obstruction to the free flow of drainage
along the side of the road or to the safe and efficient passage of
maintenance vehicles along the road.
The driveway shall be so constructed that no part of the said
driveway from the road to the point over the drainage line along the
road shall be above the level of the edge of the travel way of the
road and shall comply with the following conditions:
A. For driveways where a culvert pipe is required:
(1) For hard surface streets, the top of the driveway at the ditch line
(normally 16 feet from the center line of a fifty-foot street) shall
be a minimum of four inches below the elevation of the crown of the
road.
(2) For gravel surface streets, the top of the driveway at the ditch
line shall be a minimum of seven inches below the elevation of the
crown of the road.
B. For driveways where a culvert is not required:
(1) The top of the driveway in all cases shall be at the level of the
flow line of the drainage course along the side of the road. In no
case shall the driveway block drainage on the high side of the driveway.

Driveway culverts and storm sewer pipe shall be constructed
of reinforced concrete pipe or corrugated culvert pipe or PVC pipe,
which pipe shall comply with the accepted standards of the Pennsylvania
Department of Transportation. All pipe so used for driveway culverts
and storm sewers shall be designed to permit tight construction of
joints and carry any and all loads reasonably necessary. The diameter
of the pipe and the material used in the construction of the pipe
shall be reviewed by the Township Engineer and must meet his approval
prior to installation. In no event shall the Engineer approve of any
pipe less than eight inches in diameter or less than 20 feet in length
or which would otherwise fail to meet any applicable Pennsylvania
Department of Transportation standards.
Driveway culverts shall be constructed of either reinforced
concrete pipe or corrugated culvert pipe and the pipe selected shall
comply with the standards of the Pennsylvania Department of Transportation.
All pipe shall be designed to permit tight construction of joints
and carry any and all loads reasonably necessary. The diameter of
the pipe shall be determined by the Township Engineer previous to
installation, but the minimum shall be not less than 12 inches in
diameter with a length of not less than 20 feet.
Paved driveways constructed within the public roadway shall
remain the responsibility of the owner.

Any construction or maintenance of a driveway in violation of
this chapter shall be subject to a penalty not exceeding $600, nor
less than $100, or removal and/or reconstruction by the Township Supervisors
in accordance with this chapter at the expense of the abutting property
owner, or both.
