(a) 
Rules and regulations.
The city proposes to construct a dam across the Pedernales River at a point approximately 2000 feet downstream from the bridge across said river on U.S. Highway No. 281, to an approximate crest elevation of 1110 feet, and to thereby impound water in a reservoir upstream from such dam to such crest elevation, and to acquire control of land under such reservoir and to a line of approximately 5 feet vertically above the same, or to approximately 1115 feet above mean sea level contour line, and to withdraw water therefrom for municipal purposes and to operate a treatment plant in connection therewith. It is desirable and necessary that certain rules and regulations be adopted concerning the operation of such dam and reservoir, and the uses made thereof, to protect same from pollution and as health measures for the welfare and benefit of the people of the city using such water, to be effective as soon as the construction of said dam is completed. Effective when said dam is completed and accepted by the city, it shall be unlawful for any person to make use of the reservoir to be impounded above such dam, or any land used, owned or controlled by the city in connection therewith, contrary to the following rules and regulations:
(1) 
No person shall swim in, bathe in or enter (except for necessary maintenance of the dam, its work or the reservoir) the lake so created by said dam at any time.
(2) 
No person shall make use of said lake for fishing from a boat using a motor larger than 10 horsepower (trolling only).
(3) 
No person shall operate a boat for stunts, or at an excessive rate of speed, the circumstances considered, nor shall any boat be operated within 1/8th mile of the water intake on said dam except for maintenance, repair or other necessary purposes connected with the operation of the dam or lake.
(4) 
No person shall do any act resulting in pollution of the water in said lake to a point of endangering health of the users of the lake or water therefrom.
(b) 
Diversion of drainage from water treatment plant and sewage facilities.
The officers, agents and employees of the city shall cause to be constructed and continuously maintained a dike, ditch or other appropriate work suitable to diverting any drainage from the water treatment plant to be operated by the city from flowing into said lake or at any point above said dam. Said officers, agents and employees shall also construct, maintain and continuously use appropriate diversion facilities to protect said lake and the waters therein from any drainage from the city's sanitary sewer system or its disposal plant or attendant facilities.
(c) 
Penalty.
Any person violating any provision hereof, upon conviction, shall be deemed guilty of a misdemeanor, and shall be fined in any sum not to exceed two hundred dollars ($200.00).
