Any person, firm or corporation who violates, disobeys, omits, neglects, refuses or fails to comply with or who resists the enforcement of any provision of this article shall be fined in accordance with the general penalty provision found in section 1.01.009 of this code. Each day that a violation is permitted to exist shall constitute a separate offense.

It is unlawful for any person, partnership, firm or corporation to conduct any carnival rides or to sell any new or used goods, wares, merchandise or farm produce outside of a permanent building or structure within the city limits without having first obtained an outdoor sales permit for such sales site.

(a) 
All applications for an outdoor sales permit as specified in this article must contain the following information:
(1) 
The name, address and telephone number of the applicant, any salesperson who will be conducting sales at the site, and the officers of every applicant who is a corporation;
(2) 
The name, address and telephone number of the landowner and a written statement from the landowner showing that permission has been given to use the property as requested;
(3) 
The number of off-street parking spaces to be furnished for the site;
(4) 
The location of restroom facilities which are available on the same property or lot for customers and sales personnel or, in the alternative, if restrooms are not available on the site, written permission by neighboring businesses whose facilities are to be used;
(5) 
A certificate of insurance verifying that the applicant has procured liability insurance in a sum of not less than one hundred thousand dollars for all carnivals or similar outdoor amusements at which rides will be used;
(6) 
A showing that the proposed site of the outdoor sales or carnival is properly zoned commercial or industrial and is located more than three hundred feet from the nearest residentially zoned property;
(7) 
A nonrefundable application fee as provided for in the fee schedule found in appendix A of this code.
(b) 
An application for an outdoor sales permit shall be submitted at least five days prior to the sale date or beginning day of operation.

The following requirements shall apply to the issuance of outdoor sales permits for outdoor sales or carnivals:
(1) 
No structure, sales tables or sales items shall be located within any street right-of-way nor shall they obstruct traffic visibility;
(2) 
Any electrical connections must comply with the city electrical code;
(3) 
If a temporary power pole is required, an electrical permit must be obtained and power will not be released until all of the requirements of this article have been completed.

(a) 
A church, school, civic or other nonprofit entity who conducts a fund-raising event for a period of less than thirty consecutive days is exempt from the permit requirements.
(b) 
The sidewalk sale merchandise of any business already possessing a certificate of occupancy for the main building on the site is exempt from requiring an outdoor sales permit, provided that the merchandise is part of the business inventory and provided further that the sale site is on the same property as the main building.

Outdoor sales permits issued under this article shall be valid for a period of two months and shall not be granted in any two consecutive two-month periods.
