(a) 
Whenever any Police Officer finds a vehicle standing, parked or stopped upon a street, highway, alley or any other public place in violation of any of the provisions of this chapter, such officer is hereby authorized to remove or cause to be removed - at the vehicle owner’s expense - such vehicle and to impound the same in a storage facility or other place designated or maintained by the Town, and to hold the same until redeemed by the vehicle’s owner pursuant to section 12.07.043, or until sold at public auction as provided for in this division.
(b) 
Whenever any Police Officer finds a vehicle parked on private property in violation of section 12.07.010, such officer is hereby authorized to remove or cause to be removed - at the vehicle owner’s expense - such vehicle and to impound the same in a storage facility or other place designated or maintained by the Town, and to hold the same until redeemed by the vehicle’s owner pursuant to section 12.07.043, or until sold at public auction as provided for in this division.
(c) 
The Town Council shall select and establish a place or places owned or designated by the Town, to which place such vehicles shall be removed in accordance with this section.

When any motor vehicle has been impounded under this division, it shall be the duty of the Chief of Police to send the proper notice of impoundment as set forth in Vernon’s Texas Code Annotated, Transportation Code section 683.012, as amended.

Prior to the sale of a vehicle impounded under this division, the owner or any person legally entitled to possession of such vehicle may redeem the same by paying to the storage facility and/or the Town the fees prescribed by section 12.07.044, along with any other actual expenses incurred by the Town in impounding and keeping the vehicle.

(a) 
The Town Council shall, by resolution duly enacted at a regular meeting, establish the fees to be charged for the impounding and selling of any vehicle under this division. Such fees will include, but not be limited to:
(1) 
Taking up and impounding the vehicle;
(2) 
Storing the vehicle, per day after the first day;
(3) 
Selling the vehicle; and
(4) 
Preparing the advertisement of sale.
(b) 
The Town shall have a lien against the vehicle for the fees prescribed in this section, which lien shall be prior and superior to all other liens of any kind, save and except liens for ad valorem taxes.
